The hearing of the case was held through video conferencing on account of restricted functioning of the Courts.

The petitioner prays for grant of pre-arrest bail in a criminal case arising from FIR No.04, dated 31.01.2021, registered under Section 61 of the Punjab Excise Act, 1994, at Police Station Jhabhal, District Tarn Taran.

As per the case of the prosecution, on a raid being conducted, the petitioner along with his co-accused ran away. However, 7 drums each containing 172 Kg 'Lahan', total 1204 Kg 'Lahan' was recovered from the house of Shamsher Singh. From the reading of the order passed by the learned Additional Sessions Judge, Tarn Taran, it is apparent that the petitioner is involved in 8 more such cases. Out of the eight cases, six are for having committed offences under the Punjab Excise Act, 1994 and two are for having committed various offences under the Indian Penal Code, 1860.

The menace of distilling and selling illicit liquor is not only generating parallel economy but also endangering the lives of gullible and innocent persons.

In view thereof, this Bench is not inclined to grant the concession of pre-arrest bail to the petitioner.

Dismissed.
