BA NO. 24 OF 2017 Shri Nicky War Versus State of Meghalaya and Others BA NO. 25 OF 2017 Christopher Kurbah Versus State of Meghalaya and Others Date of Order :: 14.09.2017 PRESENT HON'BLE SHRI JUSTICE DINESH MAHESHWARI, CHIEF JUSTICE Shri K Paul, for the petitioners.

Shri S Sen Gupta PP, for the State respondents. BY THE COURT: (ORAL) Learned Public Prosecutor has placed the Case Diaries before the Court.

After attempting to make some submissions but upon this Court expressing reservations in entertaining these bail applications at this stage and that too when the petitioners have not applied for bail before the Session Judge though there is no specific bar in moving the bail applications in this Court directly, learned counsel for the petitioners submits that in the totality of circumstances, the petitioners shall stand advised not to press on these bail applications at this stage before this Court, but with permission to move for bail before the learned Sessions Judge, Shillong; and with such liberty for the petitioners, seeks permission to withdraw.

Learned Public Prosecutor has no objection. 2

BA NO. 24 OF 2017 BA NO. 25 OF 2017 Having regard to the submissions made, the petitioners are permitted to withdraw and these bail applications stand dismissed as withdrawn with liberty as prayed.

It is made clear that if any bail application is moved by the petitioner/s for consideration before the Sessions Judge concerned, the same shall be examined on its own merits as this Court has not pronounced anything on merits of the matter either way.
