                                         ORDER

Per M.Balaganesh, AM

By virtue of this stay application the assessee seeks to keep the demand of Rs. 12,24,350/- in abeyance raised by the ld. AO for the assessment year 2011-12. During the course of hearing the ld. AR prayed before us that he would be happy if an out of turn hearing is granted to him in this case, in which event, the stay petition may be treated as dismissed. The ld. DR did not object to the same.

2. We have heard the rival submissions. In the facts and circumstances of the case, we deem it fit and appropriate to grant an out of turn hearing on 18.04.2018 for which both 2 S.A.No.35/Kol/2018 A/o ITA No.444/Kol/2018 Shankar Agarwal.

A.Y.2011-12 the parties are informed in the open Court and no fresh notices would follow for the same.

3. In the result, the stay petition of the assessee is dismissed and early hearing was granted on 18.04.2018.
