Section 28(1) in The Bihar and Orissa Local Self-Government Act, 1885
(1)If the Chairman or Vice-Chairman of a District Board or Local Board is unable by reason by his death, resignation or removal to complete his full term of office, or if he ceases to be a member of a District Board or Local Board,, as the case may be, or if the Chairman of a District Board or Local Board avails himself of leave under Section 23, the vacancy so caused shall be filled by the election or appointment, as the case may be, of another person to the said office; and the person so elected or appointed shall fill such vacancy for the unexpired portion of the term for which such Chairman or Vice-Chairman would otherwise have continued in office or during the absence on leave of such Chairman, as the case may be.
