ORAL ORDER
2 08-07-20241. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 188, 290, 153(A), 295, 295(A), 296, 337, 338, 307, 332, 333, 353, 427 and 120(B) of the Indian Penal Code & Section 09 of Bihar Control of Use and Play of Loudspeaker Act.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant. It is next submitted that informant alleges that during immersion of idle of Goddess Durga, both communities started pelting stones on each other, when the procession reached near a mosque. It is next submitted that from perusal of the allegation as alleged in Patna High Court CR. MISC. No.38945 of 2024(2) dt.08-07-2024 2/2 the F.I.R., it would manifest that the allegations are general and omnibus in nature. It is also submitted that petitioner is a hawker, who was selling momo at the place of occurrence and thus came to be implicated.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bhagwan Bazar P.S. Case No.423/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
