JAGMOHAN BANSAL, J. (Oral)
1. The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondent to decide his representation seeking action against respondent-School.
2. The petitioner completed his 12th standard education from the respondent-School in 2024. He approached the authorities seeking issuance of migration certificate. His father filed complaint dated 15.07.2024 to the Block Education Officer, Gharaunda seeking action against the respondent for verbally abusing him, tarnishing his reputation and for taking ₹750 without receipt in lieu of migration certificate.
3. On 09.12.2025, the Court passed the following order:
"Although, not impleaded as a party, Mr. Parminder Singh, Advocate, counsel for Parth Public School, 1 of 2 ::: Downloaded on - 25-03-2026 04:36:50 ::: Gharaunda has put in appearance and has filed Vakalatnama, which is taken on record. He submits that before approaching this Court, petitioner, through his father, had invoked Section 22C of the Legal Services Authorities Act, 1987 and had filed a petition before the Permanent Lok Adalat (Public Utility Services), Karnal, which was withdrawn on 29.01.2025 with liberty to file a fresh petition on the same cause of action before a competent Court. He submits that thereafter a civil suit for un-liquidated damages was filed before the Civil Court at Karnal and by order dated 13.08.2024, notices have been issued. He has placed on record the xerox copies of the documents. He has categoric instructions to state that civil suit is pending. He submits that Migration Certificate has been given to the petitioner and an amount of Rs.750/-, charged from him, has been remitted back. An objection has been taken by him that the petitioner has approached this Court by suppressing the vital facts and he is not entitled to maintain the writ petition.
This Court is prima-facie of the view that as petitioner has withheld crucial information from this Court, writ petition deserves to be dismissed with heavy cost.
An opportunity is given to the petitioner to explain the reason for withholding the information.
List on 18.12.2025."
4. After arguing for some time, learned counsel for the petitioner seeks permission to withdraw the present petition.
5. Dismissed as withdrawn.
