Section 74 in The West Bengal Non-Agricultural Tenancy Act, 1949
74. Execution of decrees for arrears of rent by assignees of such decrees. -
Notwithstanding anything contained in rule 16 of Order XXI in Schedule I to the Code of Civil Procedure, 1908, an application for the execution of a decree for arrears in respect of any non-agricultural land obtained by a landlord shall not be made by an assignee of the decree unless the landlords interest in the non-agricultural land has become and is vested in him.
