PRAYER: This Civil Suit filed under Order IV Rule 1 O.S. Rules read with Order VII Rule 1 CPC,  praying for the following reliefs:

	(a) for declaration that the 1st defendant Trustees be directed and enabled to hold an appropriate inquiry with regard to the report of internal auditor M/s.Vaithiswaran & Co., dated 27.02.2010, and submit a suitable report for the benefit of all the 2nd defendant members;

	(b) to pass an order of permanent injunction forbearing the 2nd defendant from passing the accounts in its Annual General Body Meeting on 30.09.2010 at 4.00P.M at YMCA Esplanade, Chennai, without its members being apprised of the report of internal auditor M/s.Vaithiswaran&Co., dated 27.02.2010;

Learned counsel for the plaintiffs seeks the permission of this Court to withdraw the Civil Suit and he has also made an endorsement to that effect.

2. In view of the endorsement made by the learned counsel for the plaintiffs that the matter has been settled out of Court, the Civil Suit is dismissed as settled out of Court. Office is directed to refund 50% of the Court fees paid in accordance with rules.
