ORDER (ORAL)
Hon'ble Ms. Manjula Das, Chairman M.A No. 1794/2022 :
This MA has been filed by the applicants seeking permission of this Tribunal for joining in a single Application.
For the reasons stated therein, the MA is allowed and the applicants are permitted to join in a single Application.OA No. 1690/2022
2. The present Original Application has been filed by the applicants under Section 19 of Administrative Tribunals Act, 1985, seeking the following relief(s):
"(a) Direct the respondents to grant the benefit of FCS/MFCS to the applicants with all consequential benefits w.e.f. the date of eligibility in the grade and in the subsequent grades as well and to suitably modify the dates of in-situ promotions by ante dating the same from the dates when the eligibility period was completed by the respective applicants in their respective grades, as mentioned in the chart annexed herewith in the OA in the light of order passed by the Hon'ble Supreme Court in SLP (C) No. 6359/2016 on 25.08.2021 and other judgments mentioned hereinabove and forthwith.
(b) Accord all consequential benefits.23 Item No. 33 O.A. No.1690 /2022
(d) Pass any other order/direction which this Hon'ble Tribunal deems fit and proper in favour of the applicant and against the respondents in the facts and circumstances of the case."

The applicants are working/retired as Scientists in various grades under the respondents and are entitled to career advancement by way of in situ promotion / upgradation under Flexible Complementing Scheme (FCS) from one grade to another, on completion of prescribed residency period in a given grade. It is contended by the applicants that due to delay in holding the Assessment Boards, they were granted FCS promotions belatedly in various grades, which has caused undue financial loss and deprivation of promotion in the next higher grades. It is further contended that they cannot be put to disadvantageous position and financial loss due to the administrative delay attributable to the respondents, and that the promotions are required to be effected from the due dates, and the benefits extended from retrospective dates, by ante-dating the same.
4. In support of their claim, the applicants have relied upon the judgment dated 21.02.2014 in O.A. No. 1809/2013, wherein a coordinate Bench of this 24 Item No. 33 O.A. No.1690 /2022 Tribunal relying upon the judgment of Hon'ble Supreme Court in Special Leave to Appeal (Civil) No.13133/2011 - Union of India Vs. S.K. Murti, decided on 02.05.2011, and followed by the Tribunal in O.A. No. 1111/2012 titled Vinay Kumar Vs. The Secretary, Department of Electronics & Information Technology and Ors., allowed the O.A. directing the respondents to consider granting benefit of promotion to the applicants therein from the due dates, with all consequential benefits of pay fixation and payment of arrears. The aforesaid order was challenged by the respondents before the Hon'ble High Court in WP(C) No. 9049/2014, and the said writ petition was dismissed vide order dated 19.12.2014. The respondents further challenged the judgment in Vinay Kumar's case before the Hon'ble Supreme Court. The Hon'ble Apex Court in a recent judgment dated 25.08.2021 passed in Civil Appeal No.6359/2016 upheld the decision of this Tribunal, as affirmed by the Hon'ble High Court of Delhi in Vinay Kumar's case. Learned counsel for the applicants submitted that in the light of the consistent view of 25 Item No. 33 O.A. No.1690 /2022 various Courts, the benefit of in situ promotion has to be reckoned with effect from the date of eligibility, and the delay on the part of Assessment Boards cannot defeat the claim of the applicants, to which they are otherwise entitled to.

Learned counsel for the applicants further submitted that the applicants' association has also made representation to the Director General, NIC in this regard, and accordingly prayed that the present O.A. may be disposed of by directing the respondents to dispose of their representation in the light of the judgment passed by the Hon'ble Supreme Court in Civil Appeal No. 6359/2016 dated 25.08.2021, in a time bound manner.
6. Mr. Rajeev Kumar, learned counsel who appeared on behalf of the respondents, raised no objection to the prayer made by the learned counsel for the applicants.
7. We heard Mr. Ajesh Luthra, learned counsel for applicants and Mr. Rajeev Kumar, learned counsel who appeared on behalf of the respondents, at the stage of admission.

In the facts and circumstances, we dispose of the O.A., directing the respondents to consider the representation made by the applicants' association, keeping in view the judgment passed by the Hon'ble Supreme Court in Union of India & Ors. vs. Vinay Kumar (supra), and to dispose of the same by passing reasoned and speaking orders, as early as possible, and in any case not later than two months from the date of receipt of a copy of this order. It is made clear that if the applicants are found similarly situated to the respondents before the Hon'ble Supreme Court, in the aforesaid case, the respondents shall extend similar benefits to the applicants herein also; otherwise whatever decision is arrived at by the respondent authority, shall be communicated to the applicants forthwith. It is further made clear that we have not expressed our opinion on the merits of the case.
There shall be no order as to costs.
