ORAL ORDER
Mr.Shah for Mr.P.R.Nanavati appearing for respondent No.3 states that the respondent No.3 is desirous to lay the drainage pipeline without disturbing the property of the petitioner and he further states that after the work of laying down of drainage pipeline is over the land will be levelled by AUDA appropriately.
2. In view of the aforesaid statement, Mr.Purohit under the instructions of his client who is personally present in the court and identified by him states that the petitioner has no objection for the modification of the order of statusquo passed by this court on 14.9.04.
3. Under the above circumstances, the earlier order, dated 14.9.04 passed by this court shall stand modified to the effect that AUDA will be at liberty to lay down the drainage pipeline as per the declaration made by its counsel before this court and subsequent steps for levelling of the land shall also be undertaken.
