For the sake of convenience, the facts are extracted from OA No. 170/00248/2020 M. Puttaswamy vs Central Silk Board and Others.
2. Pleaded case of the applicant is that he was initially appointed as a casual Farm Worker on 07.11.1985. He was later on converted to a Time Scale labourer. After undertaking a training, he was designated as a Skilled Farm Worker. It has further been pleaded that he was granted the benefit of Casual Labourers (Grant of Temporary Status & Regularization) Scheme, 1993 in the year 2005-06 and since then he has been working as a Temporary Status Skilled Farm Worker. He was converted as a Group-D employee and his basic pay was refixed vide Office Memorandum dated 30.03.2016. By now he has completed more than 34 years of service. The respondents have implemented the recommendations of the 7th Pay Commission and accordingly his pay has been re-fixed. The applicant stands at par with the corresponding regular Group-D employees of the 36 OA.No.170/00248/2020/CAT/BANGALORE AND CONNECTED MATTERS Central Government. The applicant, though has been converted as Group-D employee, but still the respondents are not treating him as a permanent employee. It has further been stated that he is entitled to continue in the services of Central Silk Board till he attains the age of 60 years. It has been averred that the Central Government Industrial Tribunal-cum-Labour Court, Bangalore (hereinafter called as Industrial Tribunal) in CR No. 151/2007 has passed an award wherein it has been held that the demand of Time Scale Farm Workers working with the Central Silk Board for enhancement of their age of retirement from 55 years to 60 years is legal and justified. It has further been stated that this Tribunal has also allowed OA No. 170/00299/2018 (Puttaraju Vs. Central Silk Board) wherein a direction has been issued to respondent Central Silk Board to retire its employees at the age of 60 years. Claiming parity with Puttaraju's case (supra), the applicant has filed the present Original Application. The applicant herein is seeking a declaration that his retirement/superannuation at the age of 58 years is illegal. He has further prayed for a direction to respondent Central Silk Board to enhance his age of retirement uptil 60 years.
3. The respondents by way of filing a joint reply have joined the defence and opposed the applicant's claim. It has been averred that the Central Silk Board is a statutory body created by an Act of Parliament namely the Central Silk Board Act, 1948 (hereinafter called as '1948 Act'). There is no cadre and recruitment rules for casual labourers. They are appointed by the Directors of the Institute as and when it becomes necessary. Their wages 37 OA.No.170/00248/2020/CAT/BANGALORE AND CONNECTED MATTERS and service conditions are governed by the Central Silk Board after getting approval from the Ministry of Textiles. It has further been stated that the Original Application is barred by limitation as the applicant was given Temporary Status as per Circular No. CSB-9(3)/2014-Wages/Labour/Vol.II dated 23.03.2016 wherein it was clearly mentioned that the applicant's age of retirement shall be 58 years. The terms of said circular were accepted by the applicant. The present Original Application which has been filed on 23.03.2020 is, therefore, barred by limitation. On merits it has been stated that the applicant who is working as a Temporary Status Skilled Farm Worker at Ramanagara is not a permanent employee of the Central Silk Board. He was not engaged against any sanctioned post. There are no rules permitting him to continue in service beyond the age of 58 years and, therefore, he is not entitled to continue in service uptil the age of 60 years and as such he is due for retirement on 04.04.2020. It has further been averred that Writ Petition No. 18693/2014 has been filed by the Central Silk Board before the Hon'ble High Court of Karnataka challenging therein the award passed by the Industrial Tribunal. In the said Writ Petition, the Hon'ble High Court has stayed Industrial Tribunal's award subject to Central Silk Board's implementing the letter dated 08.08.2012 issued by the Ministry of Textiles, Government of India, New Delhi and, in compliance with the said interim order, the Central Silk Board has issued a memorandum to applicant intimating therein that he shall be retiring after attaining the age of 58 years. It has further been averred that the matter regarding age of retirement is sub-judice before the Hon'ble High Court of Karnataka and, therefore, no 38 OA.No.170/00248/2020/CAT/BANGALORE AND CONNECTED MATTERS order contrary to interim order passed by the Hon'ble High Court can be granted by this Tribunal. The respondent Central Silk Board has also filed additional affidavits dated 18.09.2020 and 13.10.2020 stating therein that even the order dated 04.03.2020 passed by this Tribunal in Puttaraju's case (supra) has also been challenged before the Hon'ble High Court of Karnataka in Writ Petition No. 11028/2020 (S-CAT) and by way of an interim order dated 07.10.2020 the Hon'ble High Court has stayed the said order. With all these assertions, the respondents have prayed for dismissal of the Original Application.
4. Heard learned counsels for the parties.

Shri Ravikanth, learned counsel for the applicant has submitted that the action of respondent Central Silk Board to retire the applicant at the age of 58 years is contrary to Fundamental Rule 56 (b). His further argument is that the applicant, after grant of temporary status was also converted to Time Scale Labourer and, therefore, he should be treated at par with other Central Government employees, who, in any case, retire at the age of 60 years.

Toeing almost the same line of argument, Shri Kamalesan, submitted that the action of respondents retiring the applicant at the age of 58 years is violative of Articles 14 and 16 of the Indian Constitution as the temporary status employees are entitled to same benefits which are granted to regular Group-D employees in Central Government.

Shri Venkatesh Kumar, learned counsel representing the applicants in some of the above captioned cases, further submitted that since this Tribunal has already allowed an identical Original Application in Puttaraju's case (supra) and a direction has been issued to respondents to permit the counterparts of the applicant to work uptil the age of 60 years, therefore, while granting parity with the said case, these Original Applications deserve to be allowed.

Per contra, Shri Vishnu Bhat learned counsel representing the respondents, submitted that as per Section 11 of the '1948 Act', all the acts of the Central Silk Board are subject to the control of Central Government which has accepted the age of retirement of the Farm Workers uptil 58 years only. Learned counsel further submitted that vide circular dated 23.03.2016, the age of retirement uptil 58 years was notified and to said circular no challenge was laid within the prescribed period of limitation. Therefore, the Original Application filed in the year 2020 is barred by limitation. Learned counsel still further submitted that the applicants in all the above captioned Original Applications are the members of Central Silk Board Employees Union which has been pursuing the cause before the Hon'ble High Court in Writ Petition No. 18693/2014. It is the contention of learned counsel that since the matter is sub-judice before the Hon'ble High Court, therefore, these Original Applications are wholly misconceived. Learned counsel further submitted that the applicants herein cannot even claim parity with the order passed by this Tribunal in Puttaraju's case (supra) 40 OA.No.170/00248/2020/CAT/BANGALORE AND CONNECTED MATTERS as the said order has also been stayed by the Hon'ble High Court by way of an interim order dated 07.10.2020 passed in Writ Petition No. 11028/2020 (S-CAT).
9. Considered the rival contentions of learned counsels for the parties and perused the records.

A careful perusal of the record reveals that the Central Silk Board Employees Union had raised a dispute with regard to age of retirement of its members and accordingly the Central Government had formed an opinion that an industrial dispute exists between the management of Central Silk Board and its workmen. Therefore, a reference was made by the Central Government to Industrial Tribunal under Section 10 of the Industrial Disputes Act, 1947 on 07.11.2007 to answer as to whether the demand of the Central Silk Board Employees Union for enhancement of retirement age from 55 years to 60 years is legal and justified or not. The said reference was answered by Industrial Tribunal vide its award dated 01.04.2013 holding therein that the demand of the Central Silk Board Employees Union for enhancement of retirement age of Time Scale Farm Workers from 55 years to 60 years is legal and justified and thus they are entitled to continue in service uptil the age of 60 years.

Before the aforesaid award could be announced, the Central Government, while exercising its power under Section 11 of the '1948 Act', had accorded the approval to a proposal of Central Silk Board for enhancement of the retirement age of Time Scale Farm Workers from 55 41 OA.No.170/00248/2020/CAT/BANGALORE AND CONNECTED MATTERS years to 58 years with effect from 16.07.2012. The said approval was communicated to Central Silk Board by the Ministry of Textiles vide its letter dated 08.08.2012.

The Central Silk Board, however, filed Writ Petition No. 18693/2014 before the Hon'ble High Court of Karnataka at Bangalore challenging therein the award dated 01.04.2013 passed by the Industrial Tribunal. During the course of preliminary hearing, it appears that the Central Silk Board had placed reliance upon the letter dated 08.08.2012 issued by the Ministry of Textiles and, while relying upon the said letter, the Hon'ble High Court had passed an interim order on 30.04.2014 and stayed the Industrial Tribunal's award subject to the condition that the Central Silk Board shall implement the letter dated 08.08.2012. The said Writ Petition is still pending adjudication before the Hon'ble High Court and the Central Silk Board Employees Union has been pursuing the cause.
13. The fact, that the applicants in the above captioned Original Applications are the members of the Central Silk Board Employees Union, has not been disputed by learned counsels representing them.

Though the cause is being pursued by the Central Silk Board Employees Union before the Hon'ble High Court, still Original Application Nos. 170/00299/2018, 00485/2018, 00486/2018, 00538/2018, 00564/2018, 00588/2018, 00589/2018, 00725/2018, 01277/2018, 1831/2018, 00061/2019, 00062/2019, 00063/2019, 00117/2019, 00120/2019, 00299/2019, 00403/2019, 00406/2019, 00459/2019, 00460/2019, 42 OA.No.170/00248/2020/CAT/BANGALORE AND CONNECTED MATTERS 00461/2019, 00462/2019, 00463/2019, 00464/2019, 00534/2019, 00700/2019, 00701/2019, 00702/2019, 00703/2019, 00845/2019, 00846/2019, 00847/2019, 00848/2019, 00955/2019, 01391/2019, 01674/2019, 00084/2020 and 00085/2020 were filed by various counterparts of the applicants seeking a mandate to respondents to retire them at the age of 60 years. Those Original Applications were allowed by this Tribunal by way of a common order dated 04.03.2020 (treating the Puttaraju's case (supra) as a lead case) and a declaration was given that the applicants therein will retire at the age of 60 years. The order dated 04.03.2020 is also a subject matter of challenge before the Hon'ble High Court in Writ Petition No. 11028/2020 (S-CAT) filed at the instance of Central Silk Board. The Hon'ble High Court by way of an interim order dated 07.10.2020 has stayed the order dated 04.03.2020 passed by this Tribunal in Puttaraju's case (supra).

There is no dispute with regard to the fact that the applicants herein are the members of the Central Silk Board Employees Union which has been pursuing the cause for enhancement of their age of retirement uptil 60 years. The respondents in their additional affidavit dated 18.09.2020 have also stated that since the applicants herein are the members of the Central Silk Board Employees Union, therefore, the decision taken by the Union shall be binding on them. Maintainability of these Original Applications has been seriously disputed by the respondents as the Industrial Tribunal's award dated 01.04.2013 wherein the age of retirement at 60 years has been 43 OA.No.170/00248/2020/CAT/BANGALORE AND CONNECTED MATTERS held to be justified, has already been stayed by the Hon'ble High Court in Writ Petition No. 18693/2014 subject to implementation of Ministry's letter dated 08.08.2012 by the Central Silk Board.

In this view of the matter, in our considered opinion, no mandate can be issued to respondents in the above captioned Original Applications to retire the applicants at the age of 60 years as it will go contrary to the interim order dated 30.04.2014 passed by the Hon'ble High Court in Writ Petition No. 18693/2014. Neither any interim order can be allowed to continue in favour of the applicants herein.

In any case, if the Hon'ble High Court forms a view to affirm the finding recorded by the Industrial Tribunal in its award dated 01.04.2013 and the Writ Petition No. 18693/2014 is accordingly dismissed, in our opinion, the applicants herein, who are admittedly the members of Central Silk Board Employees Union, will be entitled to get the benefit of Industrial Tribunal's award dated 01.04.2013
18. We do not find any substance in the argument of learned counsels for the applicants to claim parity with the order dated 04.03.2020 passed by this Tribunal in Puttaraju's case (supra) as the said order has also been stayed by the Hon'ble High Court by way of an interim order dated 07.10.2020 passed in Writ Petition No. 11028/2020 (S-CAT).

However, in the facts and circumstances of the case, we are of the opinion that the ends of justice will be met if the above captioned Original 44 OA.No.170/00248/2020/CAT/BANGALORE AND CONNECTED MATTERS Applications are disposed of with the observations that in the eventuality of dismissal of Writ Petition No. 18693/2014 and Writ Petition No. 11028/2020 (S-CAT) by the Hon'ble High Court of Karnataka affirming the Industrial Tribunal's award dated 01.04.2013 and the order dated 04.03.2020 passed by this Tribunal in Puttaraju's case (supra) and failure of the Central Silk Board to permit the applicants herein to continue in service uptil the age of 60 years, the applicants herein shall be entitled to get their Original Applications revived by way of filing respective Miscellaneous Applications.

Accordingly the above captioned Original Applications are disposed of with liberty to the applicants herein to get them revived in the eventuality of dismissal of Writ Petition No. 18693/2014 and Writ Petition No. 11028/2020 (S-CAT) by the Hon'ble High Court of Karnataka and failure of the respondent Central Silk Board to extend the benefit of Industrial Tribunal's award dated 01.04.2013 to applicants herein. All interim orders, wherever those are granted in the above captioned Original Applications, also stand vacated
21. Ordered accordingly. However, there shall be no orders so as to costs.
