06-10-2023 Heard Mr. K. N. Choudhury, learned Senior Counsel assisted by Mr. D. J. Das, learned counsel for the petitioner.

Aggrieved by the termination of the service of the petitioner after disciplinary proceeding and dismissal of appeal, the present writ petition has been filed under Article 226 of the Constitution of India. Issue notice, returnable by 4 (four) weeks. Requisite extra copies of the writ petition be furnished to Mr. R. Dhar, learned Addl. Senior Govt. Advocate who accepts notice on behalf of respondent Nos. 1 to 4.

It ex facie appears that no malice has alleged against respondent no. 5 and therefore for the time being issuance of notice upon the respondent no. 5 is dispensed with.
