By consent, this Writ Petition itself is taken up for final disposal.
2.The petitioner after putting in 33 = years as Headmaster, retired from service on 30.06.2001 and is receiving regular pension through The District Treasury Officer, Villupuram from 01.07.2001 onwards. The petitioner would state that on 29.03.2015, he suffered paralytic stroke and he was admitted in ESI Hospital, Villupuram immediately by way of emergency measure. Thereafter, he was shifted to Sri Ramachandra Hospital, Porur between 30.03.2015 to 17.04.2015 and took treatment in the said hospital and was discharged and he has also paid a sum of Rs.1,63,962.33p through borrowings from his relatives to pay the said amount towards medical expenses. The petitioner in this regard has submitted a representation on 20.04.2015 to the 2nd respondent, followed by another representation dated 27.05.2015 to the respondents 3 to 6 and the 3rd respondent in-turn directed the 2nd respondent to take a decision with regard to the refund claimed by the petitioner. The petitioner would state that since no order has been passed, came forward to file this Writ Petition.
3.The learned counsel appearing for the petitioner would submit that in similar facts and circumstances, this Court, vide order dated 27.03.2008 in W.P.(MD).No.2818 of 2008, directed the concerned respondents to reimburse the medical expenses and hence prays for appropriate orders.
4.Heard the submissions of the learned counsel appearing for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of the respondents 1 to 5.
5.This Court, taking into consideration the limited scope of the prayer sought for by the petitioner, directs the 2nd respondent to consider and dispose of the petitioner's representation dated 27.05.2015 on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.
The Writ Petition is disposed of accordingly. No costs.
