Section 244 in The U.P. Municipalities Act, 1916

244. Seizure of unwholesome articles and removal of deleterious and unspent drugs.

(1)If in the course of the inspection of a place under the preceding section, an article of food or drink or animal appears to be intended for the consumption of man and to be unfit therefor, the [Municipality] [Substituted by U.P. Act No. 12 of 1994.] may seize and remove the same, or may cause it to be destroyed, or to be so disposed of as to prevent its being exposed for sale or use for such consumption.
(2)If it is reasonably suspected that a drug has been improperly adulterated, or by reason of age or the effect of climate has become inert or unwholesome, or has otherwise become deteriorated in such a manner as to lessen its efficacy, or to change its operation, or to render it noxious, the [Municipality] [Substituted by U.P. Act No. 12 of 1994.] may remove the same, giving a receipt therefor, and may produce it before a Magistrate.
(3)If it appears to a Magistrate before whom a drug has been produced under sub-section (2) that the drug has been improperly adulterated or has become inert, unwholesome or deteriorated as aforesaid, he may order the same to be destroyed, or to be so disposed of as to him may deem fit, and if any offence appears to have been committed, he may proceed to take cognizance thereof.Nuisances for certain trades and professions
