The appeal is directed against the judgment and order dated 6th June, 2016 passed by a learned Judge of this Court whereby the writ petition, presented by the appellant, was dismissed relying on a judgment and order of an Hon'ble Division Bench of this Court dated 2nd December, 2015 in MAT No. 1548 of 2015. The learned Judge proceeded to hold that the appellant was ineligible to offer his candidature for appointment on the post of Assistant Professor of Drama in Visva-Bharati University, Santiniketan.
More or less the same issue of eligibility had emerged for decision before the Hon'ble Division Bench in MAT No.1548 of 2015. It is not in dispute that the judgment and order dated 2nd December, 2015 of the Hon'ble Division Bench has been challenged by the appellant by filing a Special Leave Petition before the Hon'ble Supreme Court and the same is pending.
In view of pendency of the special leave petition, we consider it appropriate to adjourn hearing of the appeal sine die.
2In the event the appellant succeeds before the Hon'ble Supreme Court, he shall be at liberty to mention the appeal for expeditious hearing. Liberty is also reserved to the learned advocates for the respondents to mention the appeal for disposal, should the Hon'ble Supreme Court reject the Special Leave Petition filed by the appellant.
