1. The present writ petition has been preferred seeking an indulgence from this Court for appearing in the examination as the petitioners' internship was going to be completed in the month of July, 2020, whereas the advertisement issued by the respondents (Downloaded on 19/11/2020 at 08:22:52 PM) (4 of 4) [CW-11192/2020] stipulated a condition that a candidate should have acquired qualification by the date of commencement of examination.
2. Learned counsel for the petitioners at the outset submits that the date of examination has been postponed on various occasions and the examinations have ultimately been held on 26.10.2020 and by such time, all the petitioners have completed their course including internship.
3. Mr. Bagri, learned counsel for the petitioners submits that the petitioners are eligible even as per the stand of the respondent-RUHS, particularly in light of the notification dated 14.9.2020.
4. He submits that the respondents have not declared petitioners' result because the petitioners have appeared in the recruitment examination on the strength of the interim order passed in the present petition and the same is pending.
5. In view of the stand taken by the respondent-RUHS as indicated above, the present writ petition is disposed of with a direction to the respondent-RUHS to declare petitioners' result forthwith. The respondent-RUHS shall however be free to decide petitioners' eligibility in view of the relevant rules/notification and the terms of the advertisement.
6. The petitioners shall be free to take appropriate legal remedies in accordance with law, if the respondent-RUHS holds them ineligible.
7. The stay applications also stand disposed of accordingly.
