Heard the learned counsel for the appellant on the application for condoning the delay.

In view of the certificate annexed with the application filed under Section 5 of the Limitation Act, issued by the Doctor, certifying that the appellant was suffering from paralysis of both lower limbs, the delay in filing this appeal is condoned.

I.A. No. 3461 of 2011 stands disposed of.

Heard the learned counsel for the appellant on the merits of the case. The learned Single Judge held that the appellant is not entitled to any benefit on the basis of his initial date of appointment, in view of the judgment of the Supreme Court rendered in the case of State of Bihar-versus-S.A. Hassan & Another reported in 2002 AIR SCW 1055. In view of the said judgment, we are of the considered opinion that no illegality has been committed in dismissing the writ petition of the petitioner-appellant.

Accordingly, this L.P.A., having no merit, is dismissed.
