ORAL ORDER
4 04-08-2014This is an application seeking a direction to the respondents to pass appropriate orders for regularization of the appointment of the petitioner against vacant sanctioned third post of Lecturer in the subject of Sahitya created by the Governing Body of Gurukul Sanskrit College, Sitamarhi in terms with the staffing pattern.
Learned counsel appearing on behalf of the petitioner submits that some of the Lecturers had approached this court by filing writ petitions being CWJC No. 14070 and other analogous Patna High Court CWJC No.15480 of 2010 (4) dt.04-08-2014 2/3 cases with similar prayer. This court has been pleased to dispose of the writ petitions with a liberty to the petitioners of those cases to approach the Vice Chancellor of the University whereupon the Vice Chancellor would direct appropriate action to be taken in this regard by following due procedure. For the benefit of quick reference, paragraphs 5, 6 and 7 are being quoted herein below:-
"5. These writ applications stand disposed of with liberty to these petitioners to approach the Vice- Chancellor of the University, who will direct appropriate action to be taken in this regard by following the procedure, some of which have been discussed in the order of Baliram Jha and make appropriate recommendation to the State Government if the petitioners fulfil the requirements of regularization of service in the said college.
6. It goes without saying that the State authorities on such recommendation will also decide what is required to be decided if they have a role to play at all since it is an affiliated college.
7. The Court expects the exercise to be completed within a period of six months from the date of filing of such application, with a copy of this order."
Learned counsel appearing on behalf of the petitioner submits that case of the petitioner may also be disposed of in terms of the said order of this court dated 27.02.2013.
Learned counsel for the University states that case of the petitioner will be considered on the basis of its own merit.
This writ application is, accordingly, disposed of in Patna High Court CWJC No.15480 of 2010 (4) dt.04-08-2014 3/3 terms of the order of this court dated 27.02.2013 passed in CWJC No. 14070 (Babu Lal Thakur vs. the Kameshwar Singh Darbhanga Sanskrit University & Ors.) and other analogous cases, as quoted above.
