The petitioners are apprehending their arrest in connection with Sarawan P.S. Case No. 08/2017 corresponding to G.R. No. 113/2017, the case registered under Sections 147/ 148/ 149/ 323/ 324/ 307/ 405/506 of the Indian Penal Code.
Learned counsel for the petitioners has submitted that there is a land dispute between the parties for which Title (P) Suit No. 139/2015 is pending before the court below.
From perusal of impugned order, it appears that there was free fight between the parties for the possession of the disputed land the members of both the parties have received injuries but no specific allegation has been attributed against the petitioners.
Learned A.P.P opposed the prayer for bail.
Considering the fact and circumstances of the case, the above named petitioners are directed to surrender in the Court below within Four Weeks from the date of this order and in the event of their arrest or surrender, the Court below shall enlarge the above named petitioners, on bail, on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand)each with two sureties of the like amount each to the satisfaction of S.D.J.M. Deoghar, in connection with Sarawan P.S. Case No. 08/2017 corresponding to G.R. No. 113/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
