1. Learned counsel for the parties state that an application under Order XXIII Rule 3 CPC has been filed. However, the same is not on record and only a copy thereof has been e-mailed by the learned counsel for the plaintiff. This appears to be because of the fact that the application is not accompanied by the apostilled affidavit on behalf of the defendant.
2. Learned counsel for the defendant states that the affidavit would need another 15 days to be apostilled.
3. List the suit and application on 22nd December, 2020.
4. Order be uploaded on the website of this Court.
