We have heard learned counsel for the parties.
The only issue remains in this case is, that Rule which is not canvassed in the writ petition or before the learned Single Judge, is with regard to rejection for regularization of the petitioner by the Corporation. Prima facie we find the only ground given is that the petitioner - respondent was over age at the time when his case was considered.
Learned counsel for the appellant takes time to seek instructions as to whether there is no other reason and also to make available the Rules in the matter of regularization. List on 27th August, 2010 and to be placed under the caption orders.
In the meantime, learned counsel for the petitioner - respondent makes a statement that they will not pursue the contempt proceedings.

This is an application under Section 5 of the Limitation Act for condoning the delay in filing the appeal. Considering the cause shown in the affidavit filed in support of the delay condonation application , the delay in filing the appeal is condoned.
