Information sought

:

1. The Appellant filed an (offline) RTI application dated 17.11.2023 seeking the following information:
"I, K. Vijayarajan S/o D. Krishnan residing at Plot No.547, 14th Street, 4th Sector, K.K. Nagar, Chennai 600078, Mobile No.9444066013 would like Page 1 of 9 to state that I was an employee of LIC Housing Finance Limited under Employee Identification No. (SR No.24004) from 17.02,1992 to 30.09.2022 and Group Savings Linked Insurance premium was deducted from my salary and remitted to LIC of India under Master Policy 658006- LIC ID-522. In this regard I wish to seek the following information under Right to Information Act 2005:-
1. The Entire statement of remittance received from LIC Housing Finance Limited with regard to my GSLI contribution from my date of joining till date of Retirement.
2. The date of my joining the GSLI scheme through my employer on the above master policy.
3. The total premium paid by me, both savings and risk portion separately.
4. The calculation based on which my GSLI settlement was done on maturity.
5. The ROI on the Savings portion of my GSLI policy
6. The reason for the less settlement of my GSLI during maturity when compared to other employees who had approximately put in equal service in the same cadre.
7. The total number of maturity claim settled during the period January 2022 to December 2022.

9. The steps taken to resolve the incorrect claim settlement as addressed in my earlier letters dated 3.07.2023, 06.08.2023 and 16.10.2023."

2. Having not received any response from CPIO, the appellant filed a First Appeal dated 11.01.2024. The FAA vide its order dated 31.01.2024, held as under.

"I have carefully examined the Appellant's RTI Application dated 17.11.2023 and the Appeal dated 11.01.2024. The matter was referred to P&GS Unit G716, being the deemed PIO and the information provided by the deemed PIO is as under:
1. The entire statement of remittance received from LIC Housing Finance Limited with regard to my GSLI contribution from my Date of Joining till date of retirement.

3. The total premium paid by me, both savings and risk portion separately.

Reply (to point 1 & 3): The GSLI scheme is not mechanized and hence the P&GS Unit G716, Mumbai Divisional Office I does not have any records of the information sought regarding provision of statement of remittance of GSLI contribution received from LIC Housing Finance Limited and Total premium paid with bifurcation of Savings and Risk portion separately, for any employee of LIC Housing Finance Limited.

2. The date of my joining the GSLI Scheme through my employer on the above Master Policy.

Reply: As per the claim form furnished by the employer, ie LIC Housing Finance Limited, the date of Applicant's joining the GSLI Scheme is Nov/1992.

4. The calculation based on which my GSLI settlement was done on maturity.

Reply: An amount of Rs. 184126/- is arrived directly by the GSLI module, which was paid on 12/10/2022 as per the covering letter attached for ready reference.

5. The ROI on the savings portion my GSU Policy. Reply: The GSLU scheme is not mechanized and hence the rate of interest cannot be determined.

6. The reason for the less settlement of my GSLI during maturity when compared to other employees who had approximately put in equal service in the same cadre.

Reply: The query does not qualify as "information" as defined under Section 2(f) of the RTI Act, 2005 However, in the spirit of RTI Act, 2005, the Applicant is informed that the amount of GSLI may differ depending on the Date of Joining and Category of the Employee.

7. The total number of maturity claims settled during the period January 2022 to December 2022.

Reply: Total 29 Maturity claims have been settled during the period from January 2022 to December 2022.

a. Number of Maturity Claims where amount settled is less than 150000. Reply: Total 11 Maturity claims have been settled where amount is less than 150000 b. Number of Maturity Claims where amount settled more than 150000 but less than 200000.

Reply: Total 5 Maturity claims have been settled where amount la more than 150000 but less than 200000 c. Number of Maturity Claims where amount settled more than 200000 but less than 250000.

Reply: Total 10 Maturity claims have been settled where amount is more than 200000 but less than 250000 d. Number of Maturity Claims where amount settled more than 250000 but less than 300000.

Reply: Total 3 Maturity claims have been settled where amount is more than 250000 but less than 300000.

e. Number of Maturity Claims where amount settled more than 300000. Reply: No Maturity claim is settled where amount is more than 300000.

8. The total number of maturity claims settled during the period January 2023 to October 2023.

Reply: Total 23 Maturity claims have been settled during the period from January 2023 to October 2023.

b. Number of Maturity Claims where amount settled more than 150000 but less than 200000 Reply: Total 2 Maturity claims have been settled where amount le more than 150000 but less than 200000.

c. Number of Maturity Claims where amount settled more than 200000 but less than 250000.

Reply: Total 13 Maturity claims have been settled where amount is more than 200000 but less than 250000.

d. Number of Maturity Claims where amount settled more than 250000 but less than 300000.

Reply: Total 3 Maturity claims have been settled where amount is more than 250000 but less than 300000.

e. Number of Maturity Claims where amount settled more than 300000, Reply: No Maturity claim is settled where amount is more than 300000.

9. The steps taken to resolve the incorrect claim settlement as addressed in my earlier letters dated 03.07.2023, 06.08.2023 and 16.10.2023. Reply: The Claim settled as per the GSLI module, is correct. It is confirmed that P&GS Unit G716, Mumbai Divisional Office I has not received the above dated letters. As such, no information can be provided.

The point-wise reply is given for all the points raised in the application. The appeal of Mr. K Vijayarajan is, as a consequence, disposed of."

3. Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal on the following grounds:

"Since the reply to few queries were vague and general and also having not received the statement of remittance made to my GSLI account asked for vide my RTI application, I had preferred this second appeal.
ln the reply to my RTI first appeal for query 1 & 3, it is mentioned that "The GSLI scheme is not mechanized and hence the P & GS Unit G776, Mumbai Divisional Office does not have any records of information sought regarding provision of statement of remittance of GSLI contribution" .ln this regard it may Page 5 of 9 be noted that the GSLI scheme has two components namely Risk and Savings portion and the Savings portion with interest is settled on maturity. Further to my RTI query 4, it is replied that "An amount of Rs.784726 is arrived directly by GSLI module". The reply is vague since for payment of savings portion of the GSLI, the said module will calculate based on the data available in the system, and without data available regarding my contribution to GSLI scheme through my employer, how the module in the system had calculated the maturity amount. All data regarding premium payment which includes savings portion is required for correct calculation of maturity amount. The said data for calculation of maturity is nothing but the statement of Remittances paid by me through my employer and denying to give the statement of remittance on the pretext of absence of mechanization is not acceptable. Hence a statement with regard to remittances made by me through my employer to the GSLI scheme may please be made available to me.
ln the reply to my RTI first appeal to my query 5, it is mentioned that "The GSLI scheme is not mechanized and hence the rote of interest cannot be determined". ln this regard it may be noted that maturity amount is paid based on the module for calculation of maturity amount. The said module should work on some logic which will include the Rate of interest to be paid on the savings portion of the GSLI scheme, The reply that the GSLI scheme is not mechanized is unacceptable since it has resulted in less settlement of my GSLI maturity and my not getting reply to my earlier letters which they have denied receiving the same and hence this RTI procedure was adopted, Hence, I may be provided with the interest rate on my savings portion of GSLI Scheme. I therefore humbly submit that this Hon'ble information Commissioner may be pleased to direct LIC of India to furnish the information of providing the Statement of my remittances to GSLI scheme with bifurcation of savings and risk portion and also to provide the Rate of lnterest on the savings portion of GSLI scheme called for in my RTI application and thus render justice."

4. A written submission dated 07.08.2024 filed by Ms. Rashmi Shikhare, Manager/ CPIO is taken on record. Relevant extracts of the same are reproduced below for ready reference:

"Second Appeal:
The Appellant in his second Appeal dated 27.03.2024 has challenged FAA's decision for Query nos. 1, 3, 4 & 5 and has contended that he has also not received the statement of remittance made to his GSLI account and the information on interest rate for his savings portion of GSLI Scheme. On Page 6 of 9 receipt of the Second Appeal, the present CPIO referred the matter again to P&GS Unit G706, being the deemed PIO in the matter as P&GS Unit G716 is merged into P&GS Unit G706 on 18.12.2023. The deemed PIO has revisited the points mentioned in the Second Appeal and the information provided by the deemed PIO is as under:
Back ground of the case:
Mr. K. Vijayarajan, the Appellant is a retired employee of LIC Housing Finance Ltd. His date of joining of LIC HFL was November 1992. He was covered under Group Saving Linked Insurance Scheme (GSLI) Master Policy Number 658006 of LIC Housing Finance Ltd. Since the new member can be included in GSLI Scheme from the next Annual Renewal Date, he was included in the scheme from Annual Renewal date 20/02/1993. His date of retirement was 30/09/2022.
The details of information sought under Query no. 1, 3, 4 & 5 of the original RTI Application is as under:
1) Statement of remittance to GSLI Scheme with bifurcation of Savings and Risk portion and the Calculation based on which GSLI settlement was done on maturity -

The said claim was settled by Sion P&GS Unit G716, MDO-I. The Sion P&GS Unit G716 was merged into Mumbai P&GS Unit G706 with effective date as 18.12.2023. The said Maturity payment of Rs. 184126/- was made in bulk transaction and the bulk payment calculation sheet as generated by the P&GS module at the time of payment is enclosed herewith, for ready reference.

The module generated calculation sheet of claim amount of Rs. 184126/- is based on the data submitted by LIC Housing Finance Ltd., at the time of settlement of claim. The sheet contains the details of contribution paid and interest earned during the period from 20.02.1993 to 30.09.2022. As per the said sheet, the total savings portion contribution of Shri X. Vijayarajan comes to Rs. 68209.32.

On receipt of CIC hearing notice, this Office of Public authority had taken all efforts and co-ordinated with LIC Housing Finance Ltd. Team for furnishing of all relevant statements bearing data of remittances towards GSLI Scheme for GSLI Master Policy Number 658006 for Appellant's membership account. The statements received from LIC HFL are enclosed herewith and it is seen that the remittance received as GSLI Savings is Rs. 68206.84 as per LIC HFL statement and Rs. 68209.32 as per module generated staternent of P&GS Unit G-706, MDO-1. As such, the P&GS Unit G-706 has taken the favourable figure of Rs. 68209.32 (which is more than Rs. 68206.84 given by LIC HFL) and has arrived at Maturity payment of Rs. 184125.61 rounded off Page 7 of 9 to Rs. 184126/-, In view of the same, the payment made to Shri K. Vijayarajan is correct and if he needs any further clarification, he may contact LIC HFL, his employer, for the same.

2) The Rate of Interest on the Savings portion of GSLI Master Policy no. 558006-The P&G5 Unit G-706, MDO-I has now informed that the Rate of Interest of GSLI Scherme applicable in the instant case are as follows:

a) Till Annual Renewal date 20/02/1999 -11% р.а.
b) From Annual Renewal date 20/02/2000 to 20/02/2003-10% р.а.
c) From Annual Renewal date 20/02/2004 till 30/09/2022-8%p.a. It is re-Iterated that in the instant case, the claim amount of Rs. 184126/- is arrived directly by the GSLI module, which was paid to the Appellant on 12/10/2022 as per the covering letter enclosed herewith for ready reference. The Claim settled as per the GSLI module, is correct. The information sought by the Appellant in his Second appeal regarding provision of the relevant statements of his contribution under GSLI Master Policy no. 658006 and the Rate of Interest applicable under the GSLI policy has been provided.

In view of the same, the Hon'ble CIC Is requested that the Second appeal filed by Shri K Vijayarajan, be dismissed summarily. The hard copy of the submission along with enclosures is sent by registered post to the Appellant at his address mentioned in his Second appeal-Plot no. 547, 14h Street, 4 sector, K K Nagar, Chennai-600078 on 11.08.2025 and also via email at his email address [email protected] ."

Relevant Facts emerged during Hearing:

The following were present:-
Appellant: Present through video conference. Respondent: Ms. Rashmi Shekhare, Manager (CRM)-cum-CPIO present through video conference.
5. Proof of having served a copy of Second Appeal on respondents while filing the same in CIC on 09.04.2024 is not available on record. On a query, the Respondent confirms non-service.
6. The Appellant stated that he has received the desired information from the Respondent during pendency of instant Appeal and is fully satisfied with the same. This Appeal may be treated as withdrawn.

Decision:

The Commission after adverting to the facts and circumstances of the case and considering the submissions of the Appellant observes that as far as information sought is concerned the Appellant is in receipt of desired information now in response to this RTI application and is satisfied with the same. Accordingly, intervention of the Commission is not warranted in the matter.

The appeal is disposed of accordingly.
