The husband of the petitioner, who was employed  as piece­rated worker at Tapin, North Colliery, died in harness on  13.03.2000.  After death of her husband all admissible post­retiral  benefits accrued to him was paid to the petitioner and her son was  granted   compassionate   appointment,   however,   arrears   of   family  pension   amounting   to   Rs.60,112/­   was   not   paid   to   her.   The  respondent­M/s  CMPF  has   pleaded   that   family   pension   of   the  petitioner was settled at the rate of Rs.749/­ per month and on  account   of   arrears   of   family   pension   from   14.03.2000   to  28.02.2006 an advice for payment of Rs.59,363/­ was transmitted  to the IDBI Bank.   Previously, the petitioner had approached this  Court in  W.P.(S) No.1899 of 2013 and she was compelled to file  Contempt   Case   (Civil)   No.578   of   2014,   still   when   interest   on  arrears   of   family   pension   was   not   paid   to   her,   she   has   again  approached this Court.   The  respondent­CMPF admits that vide  order dated 05.05.2014 passed in W.P.(S) No.1899 of 2013 this  Court has issued direction for payment of Rs.60,112/­ on account  of arrears of family pension to the petitioner, and this amount was  2. credited in her account on 03.09.2014.

3.   Vide   order   dated   05.05.2014   this   Court   has  directed the respondent­CMPF to settle the admissible claim of the  petitioner with statutory interest.   The arrears of family pension  which remained deposited with the respondent­CMPF has earned  interest,   and   therefore,   in   view   of   the   order   dated   05.05.2014  passed   in   W.P.(S)   No.1899   of   2013,   the   respondent­CMPF   is  directed to pay interest on Rs.60,112/­ to the petitioner at the rate  of 5% from 14.03.2000 to 03.09.2014.

4. The instant petition stands allowed.
