                                                                   ORDER

Petitioner has filed this petition under Article 226 of the Constitution of India making a prayer to issue direction to respondents authorities to consider his pending representation.

2. Petitioner has made prayer in this writ petition that respondents has not given him the benefit of seniority in counting the service from 13.07.2011. During that period, petitioner was attached with Central Police Vehicle Workshop, Bhopal (CPMT) and continuously worked in MT. It is submitted that benefit of aforesaid service is to be counted for purposed of seniority. Petitioner has filed a representation but same has not been considered and decided. Learned counsel appearing for petitioner submitted that some other employees were given the said benefit.

3. Heard the counsel for petitioner.

Petitioner is making a prayer for grant of benefit of service which Signature Not Verified Signed by: SHABANA ANSARI Signing time: 20-03-2026 16:36:19 NEUTRAL CITATION NO. 2026:MPHC-JBP:23209 2 WP-49179-2025 has been rendered by him in year 2011. Filing of representation will not give a fresh cause of action to petitioner. Petitioner has mentioned in this writ petition that there is no delay in filing of writ petition. Petition suffers from delay and laches, therefore, no interference is called for. Petitioner is fence sitter and if some other person has been given the benefit and if petitioner has not approached Court within time then no benefit can be given to fence sitter.

5. In view of same, petition is dismissed.
