1. Having regard to the fact and circumstances of the case and considering the allegations levelled against the petitioners coupled with the fact that as many as 150 persons were allegedly involved in installing the statue, this Court deems it appropriate to direct the petitioners to appear before the Investigating Officer on 17.10.2022 and file their representation and evidence that they were not available at the scene.
2. The Investigating Officer shall consider the same in accordance with law and complete his investigation.
3. In case the Investigating Officer comes to the conclusion that petitioners were involved in the alleged offence and cognizable offence is made out against them, he shall issue a 15 (Downloaded on 10/10/2022 at 08:11:05 PM) (2 of 2) [CRLMP-6464/2022] days' notice to the petitioners as required under Section 41-A of the Code of Criminal Procedure.
4. The criminal misc. petition so also stay petition stands disposed of accordingly.
5. Needless to observe that the petitioners' right for taking appropriate legal course in their defence(s) shall stand reserved.
