Heard learned counsels for the petitioner and the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 342, 323, 384, 504 of the Indian Penal Code and 3(1)(x) of the SC/ST (Prevention of Atrocities Act).

It is alleged that the informant has taken loan Rs. 5,000/- from the petitioner at the rate of 5% which he returned alongwith interest but thereafter the petitioner started demanding loan at the rate of 10% and claimed Rs. 30,000/- more. The other accusation is of assaulting the informant and abusing by calling caste name.

It is submitted by learned counsel for the petitioner that the petitioner demanded his loan amount Rs. 5,000/- from the informant when accusation has been levelled when offence under SC/ST Act has not been committed in public view. 2 Patna High Court Cr.Misc. No.36546 of 2012 (2) dt.25-09-2012 2/2

Considering the accusation levelled in the background of loan dispute, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Sonepur P.S. Case No. 128 of 2012 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
