SANGANNANAVAR: JUDICIAL MEMBER Mrs DIVYASHREE M: LADY MEMBER Consumer Complaint Nos.17\2019, 115\2019, 269\2019, 401\2018, 471\2018, 472\2018, 615\2018 to 620\2018, 629\2018 to 631\2018, 475/2018 BY Mrs. M.DIVYASHREE : LADY MEMBER ****** //ORDER // These are the complaints filed under Section 17 of the Consumer Protection Act, 1986 by the above named respective complainants against the OPs, who is common in all the complaints seeking similar relief involving apartments and on similar grounds and allegations. In the circumstances, as the facts, involved in all these cases are similar, one and the same they are taken up together for consideration.
The respective complainants alleged deficiency in service on the part of the OPs, sought for following prayer;
To Direct the OPs to comply with the terms of the agreement to convey the apartment premises by the Builder, Developer as mentioned in the clauses under the agreement. To Direct the Builder, Developer OPs to execute the registered sale deed and deliver physical possession of the apartment premises after removing the occupants. Determine payment of loss of rent @ Rs.20,000/- per month from 16-10-2016 till delivery of possession of the property as compensation or in the alternative, pay interest @18% p.a on the amount paid by the purchaser of the Apartment Premises and such other reliefs as the Commission deems fit.
It is the case of the Complainants in these cases that the OP Nos.1 to 19 are the title owners / land owners of the property and they have been added as Owners of the property which is under BBMP Khatha No.1661/56/2, carved out of residential converted land in Sy.No.56/2 with conversion, located and situated at Kogilu Village, Yelahanka Hobli, Banglore North Taluk, constituting 27 Guntas of land. The said property is the property to which OP Nos.1 to 19 holds title to the property.
Complainants further submits that, the title owners have entered into a Joint Development Agreement for the purposes of construction of Apartment building in undivided interest and have categorically mentioned that they have in Joint Development Agreement have undertaken to develop the entire property for the purposes of Joint Development in terms of the Joint Development Agreement dated 14.02.2014. It is a registered Joint Development Agreement. The Joint Development Agreement indicates undivided interest to be given for the purposes of Joint Development and the Builder/Developer who is the main party to the proceedings i.e., M/s B.S.R. Enterprises, a Partnership Business Concern, and the partnership business concern being a concern, it is represented by G. Praveen Kumar and Raghavendra Reddy. The Complainants have taken precaution to indicate their respective addresses which is their business concern.
The property involved is that the Builder/Developer being a partnership business concern has undertaken to build and construct in the agreement and deliver possession of Apartment building that is required to be delivered, constituting construction of residential Apartments of the proposed building named "BSR Koorla Residency". It is this document which is sought to be enforced between the Complainants and the OP. The Builder/Developer representing the OP Nos.1 to 19 holds Power of Attorney on their behalf and also hold in independent capacity and individual capacity as Joint Development and Service Provider indicating the Complainant to be the person, the Complainant who has been represented in a flamboyant manner for the purposes of purchase of the Apartment premises. Thus it is to be considered on the following:-
The Builder/Developer, the 20th OP who is added as OP, the Builder/Developer No.20 to 22 the individual names and addresses of their occupation in order to enable transaction on the basis of the complaint had undertaken, the Builder/Developer has executed an agreement holding a General Power of Attorney to sell the Apartment premises to the Complainant. The terms and conditions of the agreement are enforceable. It is the terms to build and develop Apartment premises with fixed value consideration of the Apartments. The total amount paid towards sale consideration which is acknowledge to have been received by way of cheque on the date of the agreement and the time specified is 24 months to complete the project. 24 months have lapsed. Construction work has been complete, however, compliance not taken place. In this regard legal notice is sent calling upon the Builder/Developer No. 20 to 22 the owners of the property, OP No.1 to 19 for the purposes of enforcing of the terms of the agreement and the consideration amount received as on the date of execution of the agreement and subsequently, the total amount received which is acknowledge to have been received.
According to Complainants, there cannot be an iota of complaint against the Complainants for non-compliance. The Complainants has complied with the terms and conditions without demur.
What is pertinent to be mentioned is that it is the duty and obligation of the 20th OP separately numbered as 21 to 22 being live partners and continuing partners that they have adhered to unfair trade practice of non-compliance.
The unfair trade practice is definitely as against the service provider. The service provider as 20th OP a partnership business concern represented by OP Nos.20 to 22 are required to conduct as service providers being service providers. The provision of the Act can also be kept similarly in the circumstances, which is stringent for the purposes of taking action. Therefore, the provisions being available with the specified act which is in the proceedings for the purposes and enforceable against the service providers and the similar dispute that have to be adjudicated, it becomes enforceable and falls within the provisions of deficiency in services, deficiency is allowed against the OP Nos.20 to 22.
The liability also falls upon the Owners equally as power of Attorney holder, as there has been similar objective of bring co-jointly responsible of the property owned by them and also on the basis of the Joint Development Agreement and Power of Attorney executed. Therefore, jointly and severally the OP Nos.1 to 22 become responsible for the purposes being the service provider to have committed an act of unfair trade practice in the proceedings that came to be undertaken for seeking remedial measure enforcing the provision of the Consumers Protection Act.
These complaints is presented through Advocate came to be admitted and ordered notice against OP-2 to OP-22, as 11 to 13 and 17 to 19 unclaimed, while OP's 1 to 10, 14 to 16 and 20 to 22 are left, Complainant has taken substituted service under Order V Rule 20 of CPC for service of notice to the OP's in 'Kannada Prabha', Telugu 'Prajashakthi', and Tamil 'Hindu Tamil' respectively on 25.07.2022. Since remained absent and held service of notice by way paper publication is sufficient service and thus placed ex-parte.
The Complainants submitted their affidavit evidence along with documents in particular Agreement to Sale entered between the parties and they are to be read as they are. Respective Complainants with anticipation of having their dream apartment premises offered by Ops to be executed sale deed in the name and style of "BSR Koorla Residency". In support of their case during the course of enquiry. It is to be noted herein that CP Act is a law enacted with an object to protect the interest of consumer and the procedure to be followed is summary in nature. In other words, Commission to proceed to decide the complaints on merits to impart justice to the complainants. In view of enquiry conducted by the Commission, on examination of contents of complaints, affidavit, Commission to decide on the alleged deficiency in service on the part of OPs and if it is shown to decide what reliefs could be granted in favour of the Complainants.
On behalf of complainants each of them chooses to file their respective affidavit in lieu of oral evidence. The complainant in each case explained. The complainant in each case explained in detail the date of agreement, the flat which they booked, the promised date of delivery and the total sale consideration amount etc,. The Complainants in all the cases have reiterated the fact stated in the complaints in their respective pleadings, in the affidavits filed in the form of their evidence in chief. Out of total sale consideration amount, the OPs complainants in each case have paid some amount by way of cheque towards purchase of apartment premises and the OPs also executed agreement to sell in each case of the complainants respectively agreeing to execute the sale deed within 24 months from the date of the said agreement to sell. To find support complainants in each case have produced copy of agreement to sell, where in it is evident for the amount paid by the complainants are acknowledged by OPs.
On perusal of the agreement, admittedly, it is shown, under the agreement to sell, provided penalty clause and the OPs agreed to execute registered sale deed pertaining B-Schedule property for getting all such legal permissions. Yet OPs failed to fulfill their obligation in all these respective cases. Further on perusal of Agreement to Sale entered between the parties in particular clause 14 to 16 reads as thus:
If the vendor/developer fails to sell the Schedule 'B' Property in terms of this agreement, the purchaser is at liberty to enforce specific performance of this agreement, or in the alternative seek return of the advance amount paid on this day and afterwards and the purchaser also entitled a sum of Rs. 3,00,000/- (Rupees three Lakh Only) towards damages. The vendors/developer agreed to pay the damages as stated as above. Possession of the Schedule 'B' Property will be delivered to the purchaser at time of registration of the sale deed. The Developer should complete the construction in all respects, providing all amenities, fixing all fittings, etc., executed and register the sale deed and deliver the possession of the Schedule 'B' Property to the purchaser.
Thus considering these vital aspects of the Agreement to Sell coupled with other documents placed on record, since OPs failed to rebut contents of affidavit submitted by complainants and documents, complainants has to be held proved the alleged deficiency of service on the part of OPs, since they proved to be failed to keep up their promises agreed under the Agreement to Sell.
The respective complainants had invested their huge hard earned money with fond hope of having their dream house. If they had invested this amount elsewhere in some other project, could have valued more. Thus, due to the deficient act of OPs, the respective complainants suffered mental agony and financial loss. In our view, complainants cannot be made to suffer and wait indefinitely for possession of the apartment allotted to them. With such conclusion, Commission proceed to allow the complaint in part and direct OPs to execute the registered sale deed by collecting balance sale consideration amount from the respective complainants as per the agreed terms and conditions of the agreement and deliver physical possession of the apartment premises. Hence taking into consideration the inconvenience caused to the complainants, we are of the opinion that compensation of Rs.1,50,000/- may be awarded to each of the complainants. Hence we pass the following;
The complaints are allowed with cost.
OPs are jointly and severally hereby directed to convey the apartment premises there on to the respective complainants as per the agreed terms and conditions of the agreement.
OPs are jointly and severally hereby directed to execute the registered sale deed free from all encumbrance in favour of each of the complainants separately collecting remaining balance amount out of the total sale consideration if any, as per the agreed terms and conditions of the agreement and deliver physical possession of the apartment premises after removing the occupants within 03 months from the date of receipt of this order.
OPs further directed to pay to the respective complainants Rs.1,50,000/- towards damages as compensation and Rs.25,000/- towards cost of the litigation expenses to each of the complainants.
In case OPs fails to deliver the possession of the property it is also necessary for us to order OPs to pay each of the complainants a sum of Rs.500/- as damages per day for the delay caused in deliver physical possession of the apartment and the said amount to be paid till handing over the physical possession of the apartment in all respect as per the agreed terms and conditions of the agreement. Keep the original order in CC/401/2018 and copies in other connected matters.
