Section 86(2)(a) in The West Bengal Housing Industry Regulation Act, 2017

(a)the provisions of the said enactments shall apply in relation to any proceeding relating to any real estate project which commenced before this Act came into force unless otherwise agreed by the parties but this Act shall apply in relation to proceedings which commenced on or after this Act comes into force;
