Section 11 in The Mumbai Metropolitan Region Development Authority Act, 1974
11. Officers and servants of the Authority.
(1)The State Government shall appoint a Metropolitan Commissioner. State Government shall by order determine, from time to time, the salary and other terms and conditions of service of the Metropolitan Commissioner. He shall be appointed for such period not exceeding 3 years as the State Government may decide, and the appointment may be extended from time to time for a period not exceeding three years at a time:Provided that, the State Government may at any time -(a)if the Metropolitan Commissioner holds a lien on the service of the State recall him to such service, after consultation with the Authority;(b)remove him from office, if it shall appear to the State Government that he is incapable of performing the duties of his office or has been guilty of any misconduct or neglect which renders his removal expedient:Provided further that, if the Metropolitan Commissioner holds a lien on the service of the State, he shall forthwith be recalled to such service, if so requested by the Authority by passing a resolution for his recall:Provided also that, the Metropolitan Commissioner may resign his office by tendering his resignation in writing to the Chairman of the Authority, but such resignation shall be effective only on its acceptance by the Chairman of the Authority.[[* * * * * *] [Sub-section (1A) and (1B) were inserted by Maharashtra 29 of 1976, Section 9(a).](1B)The State Government may on a request being made by [the Executive Committee] [These words were subtituted for the words 'the standing Committee' by Maharashtra 30 of 1983, Section 9(b).] appoint one or more Additional, [Joint] [This word was inserted by Maharashtra 5 of 2003, Section 2(a), w.e.f. 15-11-2003.] Deputy or Assistant Metropolitan Commissioners. The State Government shall by order determine, from time to time, the salary and other terms and conditions of service of an Additional Metropolitan Commissioner, [a Joint Metropolitan Commissioner] [These words were inserted by Maharashtra 5 of 2003, Section 2(b).] a Deputy Metropolitan Commissioner and an Assistant Metropolitan Commissioner.](2)The Authority may, from time to time [sanction creation of posts or other officers and servants subordinate to the Authority [* * *] [These words were substituted for the words beginning with 'appoint' and ending with 'considers necessary', by Maharashtra 29 of 1976, Section 9(b).] as it thinks necessary.] The conditions of appointment and service and the powers and duties of such officers and servants shall be such as may be determined by regulations.
