ORDER
1. The Appellant filed an RTI application dated 03.03.2024 seeking information on the following points:
With reference to Schedule of Presentation & Personal Interview letter no.
NITR/DN/2024/M/0027 dated 19th February 2024 published on NIT Rourkela website, kindly provide the following information
1. The criteria for preparing the Scrutiny list for Shortlisted candidates in the Electrical engineering Department.
2. Number Candidates Shortlisted for Presentation & Personal Interview for the post of Assistant Professor (Grade 1) in the discipline of electrical engineering Page 1 of 4
3. Number of vacant positions of Assistant Professor (Grade 1) in the discipline of electrical engineering as per Faculty Recruitment Advertisement No. NITR/ES/06/2023, Dated - 18th December 2023.
2. Having not received any response from the CPIO, the Appellant filed a First Appeal on 06.04.2024. FAA's order, if any, is not available on record.
3. Aggrieved with the non-receipt of the FAA's order, the Appellant approached the Commission with the instant Second Appeal dated 17.06.2024.
4. The appellant and on behalf of the respondent Mr. Chitranjan Shahoo, CPIO, attended the hearing through video conference.
5. The appellant inter alia submitted that after the delay of 5 months, an unsatisfactory reply was provided by the Respondent. He requested the Commission to direct the respondent to furnish the information as sought.
6. When queried by the Commission regarding late response furnished to the RTI application, the respondent submitted that a response to the RTI application had been furnished on 08.08.2024 and the same is reproduced as under:-
1. UR candidate must have first class / first division throughout his/her academic career (starting from class X). 2. For PWD/SC/ST/OBC/EWS candidates, First class in UG and PG along with one second class in 10th/12th is permissible.
However, combined average marks of 10th and 12th must be 60% or above. 3. The specialization (B. Tech.. M. Tech. and Ph. D.) should meet the Departmental needs for courses offered to B. Tech. and M. Tech. programs. 4. The cut off mark of B. Tech. and M. Tech. degree is 70% or 7.5 CGPA (for UR and OBC). The cut off mark for SC, ST, EWS and PWD candidates in B. Tech. and M. Tech. degree is 65% or 7.0 CGPA. 5. M. Tech. and Ph. D. degrees must be from Govt. Institute or Institutes/Universities ranked by NIRF within 50 in Engineering/ QS ranking within 600. (Or, Sl. No. 6) 6. If a candidate does not have M. Tech. degree, B. Tech. should be from Govt. Institute or Institute/University within NIRF Engineering rank 50. Percentage of marks in B. Tech. should be more than 70% Page 2 of 4 (or CGPA 7.5). However, for SC, ST, EWS and PWD candidates the percentage of marks in B. Tech. should be 65% (CGPA 7.0) or above. 7. The candidate must have at least four publications in SCIE indexed journal or three SCIE journal publications with one sponsored R & D project as Principal Investigator. 8. The candidate must have at least 03 year post Ph. D. or 06 years total experience of Teaching and Research in Institution of repute (NIRF ranking within 150/ QS ranking within 800) /Industry /R&D Lab. 9. The candidate must have at least 20 Credit points.
Q. No. 02: Number of Candidate Shortlisted for Presentation & Personal Interview for the post of Assistant Professor (Grade I) in the Department of Electrical Engineering was 01.
Q. No. 03: Total number of vacant position in the department of Electrical Engineering was 06. As per the CIE Act 2019 and four tire flexible cadre structure, the segregation of post is not done at Department Level. The segregation for various levels of post is done al institute Level; accordingly, the vacant positions were advertised."

The Commission after adverting to the facts and circumstances of the case, hearing both parties and perusal of records, observes that there is considerable delay of 4 months in disposing the RTI application and the respondent failed to explain the cogent reasons for such inordinate delay. Therefore, the Commission directs the CPIO to submit a written explanation before the Commission, stating the reasons for the above said delay by uploading on http://dsscic.nic.in/online-link-paper-compliance/add, within 20 days from the date of the receipt of this order, under intimation to the Commission. However, the CPIO has provided an appropriate reply to the RTI queries, hence, the Commission finds no scope of intervention in the matter. With this observation, the appeal is disposed of.
