ORDER (ORAL)
Mr. V. AJAY KUMAR, MEMBER (J) :-
Heard Shri Lalit Kumar Jha, learned counsel for applicant and Shri Rajeev Kumar with Ms. Radha Lakshmi R., learned counsel for respondents.
2. The applicants earlier filed the OA No.1755/2017 seeking the following reliefs :-
"a. Direct the respondents to grant salary, remuneration and all other entitlements to the present applicants, on the basis of doctrine of 'equal pay for equal work', equivalent to the regular employees, as detailed in the present Original Application viz a viz judgment passed by the Hon'ble Supreme Court of India in CA. NO.213/2013 titled as "State of Punjab Versus Jagjit Singh & Ors", in the interest of justice.
b. For an order directing the Respondents to improve the pay and service conditions of applicants"
3. The said OA was disposed of by this Tribunal by an order dated 19.05.2017 as under :-
"4. It is submitted that the applicants have made number of representations ventilating their grievances including Annexure-A/3 representation dated 10.08.2016 followed by Annexure-A/4 representation dated 20.12.2016 and Annexure-A/6 representation dated 20.01.2017. However, respondents have not passed any orders thereon till date.

In the circumstances, the OA is disposed of without going into the merits of the case, with a direction to the respondents to decide the aforesaid representations of the applicants by passing a reasoned and speaking order within a period of 90 days from the date of receipt of a certified copy of this order, in accordance with law. No costs.
6. Let a copy of the OA be enclosed to this order."

The respondents by stating that they have passed a speaking order on 06.07.2017, without taking any view on the claim of the applicants, as directed by this Tribunal, however, sought certain information from the applicants to take a final view. Accordingly, the applicants submitted required information to the respondents. Though the respondents failed to comply with the orders of this Tribunal by not passing any final order accepting or rejecting the representation of the applicants, the applicants instead of bringing the said violation of the orders of this Tribunal in OA No.1755/2017 dated 19.05.2017, by way of appropriate petition, filed the instant OA, once again, with the same reliefs i.e. what they have prayed in the earlier OA.

Once an order was obtained by the applicants in a particular manner from this Tribunal in an O.A. and when it is their case that the said order was not complied with by the respondents, filing a fresh OA seeking same reliefs is not proper and the same is not maintainable, as per law. Accordingly, the instant OA is 19 OA No.593/2018 dismissed. However, today the learned counsel for respondents while producing an order dated 19.03.2018, whereunder they have constituted a Committee comprising of three senior officers to look into the claims of the applicants, wherein it was also mentioned that the report of the said Committee should be submitted within three weeks from the issuance of the order, submits that they are in the process of considering the claims of the applicants. In view of the same, it is made clear that this order shall not preclude the respondents from considering the claims of the applicants at the earliest. Simultaneously, this order shall also not preclude the applicants from availing their remedies, in accordance with law, in respect of their claims already decided by this Tribunal in the earlier OA.
6. Pending MAs, if any, stand dismissed.
