1. Counsel for the plaintiff submits that the matter has been settled out- of-Court. Accordingly, he has instructions to withdraw the present suit.
2. The suit is dismissed as withdrawn.
3. In view of the judgment of the Supreme Court in High Court of Judicature at Madras, Represented by its Registrar General Vs. M.C. Subramaniam and Ors. (2021) 3 SCC 560 followed by this Court in Western Infrabuild Products LLP Vs. Western Steel India and Ors. MANU/DE/0028/2022, Court fees is directed to be refunded.
4. The Registry is directed to issue certificate for refund of entire Court fees in favour of the plaintiff in terms of Section 16 of the Court Fees Act, 1870.
