07/19.07.2021 These cases are taken up through Video Conferencing.

I.A. No. 2079/2021 [W.P.(C) No. 767/2021] The present Interlocutory application has been filed on behalf of the petitioner for impleading M/s Sarvesh Refractories Pvt. Ltd., Rourkela (Odisha) and M/s TRL Krosaki Refractories Ltd., Belpahar (Odisha), whose descriptions have been given in paragraph 8(C) of the present interlocutory application, as the respondent Nos. 5 & 6 respectively in the said writ petition on the ground that they have been awarded the work in question during the pendency of the same.

The petitioner has also sought insertion of further prayers in the said writ petition, as has been detailed in paragraph 8(B), 8(D) & 8(F) as well as the relevant facts, as mentioned in paragraph 8(A) & 8(E) of the present interlocutory application.

Having heard learned counsel for the parties and keeping in view that the work in question has been awarded in favour of the proposed respondents during the pendency of the said writ petition, whose descriptions have been given in paragraph 8(C) of the present interlocutory application, the petitioner is permitted to implead them as the respondent Nos. 5 & 6 respectively in the said writ petition.

The petitioner is also permitted to carry out necessary amendments in the relevant part of the said writ petition as has been mentioned in paragraph 8(A), 8(B), 8(D) & 8(F) as well as 8(E) of the present interlocutory application.

Let necessary insertion in the said writ petition be made by learned counsel for the petitioner by 23.07.2021 by red ink.

Issue Dasti notice to the newly impleaded respondent Nos. 5 & 6 for which requisites etc. must be filed by 27.07.2021.

The petitioner shall hand over the said Dasti notice to the respondent No.4 by 30.07.2021, who in turn, shall ensure service of the said Dasti notice upon the newly impleaded respondent Nos. 5 & 6.

The petitioner as well as the respondent No.4 shall file respective affidavits with regard to service of Dasti notice upon the respondent Nos. 5 & 6 within two weeks.

W.P.(C) Nos. 88/2021 & 767/2021 Put up these cases on 23.08.2021 under appropriate heading. Till then, the interim order dated 10.02.2021 passed by this Court in W.P.(C) No. 88 of 2021 shall continue.
