ORDER (ORAL)
Hon'ble Mr. Pradeep Kumar, Member (A):
The applicants herein, total 50 in number, are the candidates for Common Graduate Level Examination - 2018 (CGLE-2018), conducted by Staff Selection Commission (SSC). The exam consists of four stages : Tier 1, Tier 2, Tier 3 and Tier 4. They had been successful in Tier I and Tier II stages. They appeared in Tier III examination on 29.12.2019 for which result was declared on 30.09.2020. The applicants have not qualified the same and the rejection list declared on 07.10.2020 indicates reason "Rejected- Without signature".
2. The last stage of the examination is Tier IV,is scheduled to be conducted on 18th and 19.12.2020.
3. On being rejected in Tier 3, the applicants had made a representation dated 15.10.2020, pleading that the deficiency of one signature was not fatal. It is pleaded thatthe reason for rejection was indicated candidate wise, which indicates that their answersheetscould still be identified as to which 9 OA 1647/2020 candidate it belongs to.Thus their case needs to be decided on merit and not on hyper-technical ground of a missing signature. The applicants had also relied upon certain judgments.
4. Heard. Issue notice. Shri Ravinder Kr Sharma, learned counsel, who appears on advance service for respondents (SSC), accepts notice.
5. At this stage, learned counsel for the applicants submitted that if certain time bound direction can be passed to the respondents to decide upon their pending representation, they will be satisfied.
6. Keeping this in view, the OA is disposed at this stage, without going into merits of the case, with directions to respondent herein to take into account the relied upon judgments, and pass a reasoned and speaking order on the pending representations dated 15.10.2020, within a period of four weeks, of this order being uploaded on the CAT website, under advice to the applicants.
7. All pending MAs also stand disposed of.
