This application having been heard on 03.12.2020 through video
conferencing, the Tribunal on the same day delivered the following:
O R D E R (Oral)
Hon'ble Mr. P. Madhavan, Judicial Member -
Heard Advocate Dr. V.N. Sankarjee appearing for the applicants and the learned counsel appearing for the respondents through video conferencing.
2. The applicants are employees working under the 2nd and 3rd respondents and their probations were declared and services were duly regularized. The Pension Fund Regulatory and Development Authority (in short PFRDA) Ordinance was lapsed on 7.4.2005 and their appointments were made while the Ordinance stood lapsed. The PFRDA received assent of the President on 18.9.2013 and was published in the Indian Gazette Ordinary No. 33 dated 19.9.2013. Neither the PFRDA Ordinance nor the 6 PFRDA Act, 2013 and nor the resolutions of the Government of India are applicable to them and therefore, they are entitled to the benefits of the Pensions Act, 1871 and the Central Civil Servants (Pension) Rules, 1972. Moreover, the notification inviting application for their appointment to the posts also did not contain any recital that they would be governed by the New Pension Scheme. The applicants submitted representations Annexures A46 to A90 to provide them the benefits of the statutory pension but the respondents have not even taken any decision so far. Hence, they have filed the present OA seeking the following reliefs:
"i) Declare that the applicants are entitled to the benefit of the Statutory Pension Scheme under the Pensions Act, 1871 and the Central Civil Servants (Pension) Rules, 1972;
ii) Direct the respondents to provide the benefit of Statutory Pension Scheme to the applicants;
iii) Declare that Section 56 of the Pension Fund Regulatory and Development Authority Act, 2013 is unconstitutional and void;
iv) Declare that the resolutions No. F. No. 5/7/2003-ECB & PR dated 10.10.2003 and F. No. 1(6)2007-PR dated 14.11.2008 (Annexure A91) mentioned in Section 56 of the Pension Fund Regulatory and Development Authority Act, 2013 as unconstitutional and void, if the same is found necessary; and
v) Pass such other orders as are deemed fit and necessary in the interest of justice and for proper and effective adjudication of the case."
3. When the matter came up for consideration, it appears that Annexures A46 to A90 are the representations filed by the applicants and they are still pending with the respondents and no action is taken by the respondents so far. Respondents have no objection in considering the representations filed by the applicants. Since the remedies are not exhausted, we feel it appropriate to dispose of this OA with a direction to the competent 7 authority to consider Annexures A46 to A90 representations filed by the applicants and pass a reasoned and speaking order in the light of the relevant rules and regulations within a period of six months from the date of receipt of a copy of this order. OA is disposed of without going into the merits.
4. The OA is disposed of as above at the admission stage itself. No costs.
