1. Learned Counsel who appears on behalf of the Petitioner/tenant submits that the issue in the present Petition was crystalised in the order dated 13.09.2022 passed by a Coordinate Bench of this Court when Notice was issued to the Respondent/landlord.
2. Learned Counsel for the Petitioner/tenant submits that the Respondent/landlord have been served, through his Counsel, on 10.04.2023 via courier and the same has been delivered on 20.04.2023. A copy of the courier receipt and its tracking report is annexed at Annexure A (colly.) to the case file.
2.1 Learned Counsel for the Petitioner/tenant submits that possession of the premises i.e., one shop out of the property bearing no. 407/D-1, Gadodia Road, Than Singh Nagar. Anand Parbat, New Delhi-110005 has been taken over by the Respondent/landlord in Execution Proceedings on 08.12.2022.
