"It ig fairly well-settled position in law that on basic principles proceedings in criminal case and departmental proceedings can go on simudtaneously, excepi In some cases where departmental proceedings and eriminal case are based on the scone set of facts and the evidence in both the preceedings is common. It ts in these cases, the Court has to decide, taking into account special features of the case, whether siendtaneous continuance of both would be proper".

The criminal prosecution is lawnched for an offence for violation of a. duty the offender owes fo the sacteiy, or for breach of which law has provided that the offender shall make satisfaction to the public. So crime is an act of commission in violation of law or of omission of public duiy. The departmental enquiry is to maintain diseipline in the service and efficiency of publle service. RB 20 O8 Nos. 286/20 & 294/20 would, therefore, be expedient that the disciplinary proceedings are conducted and completed as expeditious shy as possible, If is nai, therefore, desirable to lay dawn any guidelines as inflexible rules in which the e deparine ental praceedings may ar may nat be staved pending rad i criminal case « 10 inst the delinquent offleer.
