FACTS
Heard today dated 2.2.2012. The parties have not appeared before the Commission. Hence, the matter is being decided on the basis of material on record.
2. It is noticed that in RTI application dated 13.12.2010, the appellant had sought the postal address, name and telephone numbers of the person having IP address 117.192.107.229. The reason giving by him was that the person holding the above IP address had created nuisance and sent obnoxious e-mails etc. Vide letter dated 11.1.2011, the CPIO had refused to disclose this information u/s 8 (1). The Appellate Authority had also taken the same view in order dated 2.2.2011.
3. We have considered the appellant's request. The holder of IP Address under reference is entitled to his privacy. If he has indulged in any unlawful activity, the appellant will be well advised to bring this matter to the notice of police for appropriate action. We may also add that the ruling of this Commission in File No. CIC/DS/C/2010/00138/LS relied on by the appellant does not apply in the present case. In this case, the third party had rang up the appellant on his mobile number at the dead of night and there was documentary proof in regard thereto, the identity of the caller was ordered to be disclosed in these peculiar circumstances. From the RTI application, we do not gather the impression that any serious harm or injury has been caused to the appellant. Hence, we are not inclined to interfere with the decisions of the CPIO and AA. The matter is ordered to the closed.
