Prayer in this petition is for quashing of complaint No.SC-61, instituted on 08.12.2016, registered under Sections 18 and 27 of Drugs & Cosmetic Act, 1940.

At this stage, learned counsel for the petitioners restricts his arguments only with regard to granting exemption from personal appearance on the ground that the petitioners-accused are residing at New Delhi and it is difficult for them to appear before the trial Court on each and every date and seeks permission to approach the trial Court for raising all the pleas/defences and to avail alternative remedy, in accordance with law.

Learned counsel for the petitioners submits that the petitioners will appear through their counsel before the trial Court and will not raise any objection subsequently for arguments on miscellaneous application; for recording any evidence etc. in their absence. However, in case the petitioners' counsel fail to cooperate with the proceedings before the trial Court, it will be open for the trial Court to direct for their personal appearance before the trial Court.

In view of the above, this petition is disposed of with a direction to the trial Court that in case an application under Section 205 1 of 2 ::: Downloaded on - 10-09-2017 06:31:41 ::: CRM-M-32826-2017(O&M) -2- Cr.P.C. is filed by the petitioners, the Court will grant exemption from personal appearance of the petitioners on the aforesaid conditions or any condition laid down by the trial Court.
