ORDER
This petition has been filed to quash the FIR registered in Cr.No.4 of 2023 on the file of the first respondent.
2. Though notice was served on the second respondent and her name is also printed in the cause-list, no one appeared before this Court neither in person nor through counsel.
3. The case of the prosecution is that the petitioner has signed in the letter and submitted to the STC Chairman TNRSA in the name of the team mentioning the players in the sports of Skating Academy. The petitioner is the Administrator and the Teacher of Achievers Speed Skating Academy, having its Head office at Coimbatore.
4. While being so, in the month of October, the private school in Karur has organized the State level competition in skating in which the second respondent's son participated and secured two gold medals. Subsequently, her son was qualified to the national level 2/6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 09/06/2025 02:22:54 pm ) Crl.OP.No.16234 of 2023 which was happened on 09.11.2022 in Coimbatore, wherein her son has secured second and third place and scoring total of four points.
5. The second respondent further alleged that the petitioner has informed her that her son has not been selected to the National Level Skating Competition. However, subsequently on 21.11.2025, the State Level Scatterers list was released, in which, her son's name Has duly appeared.

It is further alleged that the petitioner being the Head Coach signed in the letter for not willing to participate in the tie- breaker match as a representative of Achievers Speed Scatting Academy and gave it to STC Chairman TNRSA without the consent and permission of the parents of the candidates. Hence, the second respondent lodged a complaint against both the Head Coach of Achievers Speed Skating Academy in Coimbatore viz., Thangadurai/petitioner and the Mukilarasan, Head Coach of the said Academy in Karur Division.

7. The learned counsel for the petitioner submits that admittedly, the petitioner has only signed in the letter on behalf of his team. Therefore, the offence of forgery does not arise. The offence of forgery is defined under Section 463 of IPC. As per the said section '' making any false document'' is vital to bring home the charge of forgery. Admittedly, the petitioner has only signed in the said document and there is absolutely no material to attract the offence of forgery. The petitioner never forged any signatures of the players. That apart, after the said letter, the second respondent's son has participated in the tie-breaker match and lost. Only after having lost in the tie-breaker match, the present complaint has been lodged.

Considering the facts and circumstances of the case and the submissions made by the learned counsel appearing for the petitioner and on perusing the materials available on record, this Court is of the view that the complaint itself is nothing but clear abuse of process of law and the entire allegations cannot be sustained as against the petitioner and liable to be quashed. Accordingly, the FIR registered 4/6 https://www.mhc.tn.gov.in/judis ( Uploaded on: 09/06/2025 02:22:54 pm ) Crl.OP.No.16234 of 2023 in Crime No.4 of 2023 on the file of the first respondent police is hereby quashed.
9. In the result, this Criminal Original Petition is allowed. Consequently, the connected miscellaneous petition is closed.
