(Oral) Feeling aggrieved against the alleged inaction on the part of respondent authorities, petitioner has approached this Court by way of instant writ petition under Articles 226/227 of the Constitution of India, seeking a writ in the nature of certiorari/mandamus.

Learned counsel for the petitioner, at the very outset, fairly states that he does not intend to press this petition qua the writ of certiorari, for the time being. However, he submits that given an opportunity, petitioner shall approach the competent authority, i.e. respondent No.2 by moving an appropriate representation along with all the material available with the petitioner for consideration of his grievance for absorption in the respondent-Board and he may be directed to consider and decide the same, within a reasonable time.

Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, Chief Administrator, Haryana State Agricultural Marketing Board-respondent No.2, is directed that if the MUKESH KUMAR SALUJA CWP No.26052 of 2014 -2- 2014.12.19 17:50 I attest to the accuracy and authenticity of this document petitioner approaches him by moving an appropriate representation within a period of two weeks from today, he shall consider and decide the same, at an early date, by passing an appropriate order thereon, strictly in accordance with law, but in any case within a period of four weeks from the date of receipt of representation from the petitioner. RAMESHWAR SINGH MALIK, J. (Oral) Feeling aggrieved against the alleged inaction on the part of respondent authorities, petitioner has approached this Court by way of instant writ petition under Articles 226/227 of the Constitution of India, seeking a writ in the nature of mandamus.

Case called twice. Neither anybody has come present on behalf of the petitioner nor any request for pass over has been made.

After careful perusal of the record of the case, this Court is of the considered view that in view of communication dated 9.4.2014 (Annexure P-2) issued by respondent No.2 to the petitioner, the matter regarding regularisation of services of contingent paid employees was under

consideration of the Government. It has further been stated therein that as and when the appropriate policy is issued by the Government, necessary action in this regard will be taken, accordingly. The relevant part of communication dated 9.4.2014 (Annexure P-2), reads as under:-
"It is to inform you that Shri Subhash son of Shri Balbir Singh was appointed as Member Bhajan Party on fixed MUKESH KUMAR SALUJA CWP No.23973 of 2014 -2- 2014.12.19 17:50 I attest to the accuracy and authenticity of this document monthly wages paid out of contingencies and he is working such as in the Office of DIPRO, Sonipat. The policy regarding regularization of service of contingent paid employee is under consideration by the Government as and when policy is issued by the Government. Necessary action in this regard will be taken accordingly.

In view of the above, the present writ petition is prima facie premature and the same is hereby disposed of, as such.

RAMESHWAR SINGH MALIK, J. (Oral) Feeling aggrieved against the alleged inaction on the part of respondent authorities, petitioner has approached this Court by way of instant writ petition under Articles 226/227 of the Constitution of India, seeking a writ in the nature of mandamus.
Learned counsel for the petitioner submits that when the grievance of the petitioner was not being redressed, he finally approached the respondent authorities, by way of legal notice dated 16.7.2014 (Annexure P-6), but the same is also pending decision. He further submits that the petitioner will be satisfied in case respondent No.2 is directed to consider and decide the legal notice of the petitioner, within a reasonable time.
Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of case, including the issue of limitation, if any, lest it should prejudice the rights of either of the parties, Superintending Engineer (Admin-2), HVPNL-respondent No.2, is directed to look into the matter, consider the grievance of the petitioner raised vide MUKESH KUMAR SALUJA CWP No.26174 of 2014 -2- 2014.12.19 17:50 I attest to the accuracy and authenticity of this document his legal notice dated 16.7.2014 (Annexure P-6) and decide the same at an early date, by passing an appropriate order thereon, strictly in accordance with law, but in any case within a period of three months from the date of receipt of a certified copy of this order.

(Oral) Feeling aggrieved against the alleged inaction on the part of respondent authorities, petitioner has approached this Court by way of instant writ petition under Articles 226/227 of the Constitution of India, seeking a writ in the nature of mandamus.

Learned counsel for the petitioner, at the very outset, fairly states that although petitioner is seeking only a writ in the nature of mandamus, yet he could not serve the respondent authorities by way of an appropriate and self-contained representation because the cryptic application dated 12.9.2014 (Annexure P-4) submitted by the petitioner, was lacking in material particulars. He further submits that given an opportunity, he himself will serve the competent authority, i.e. respondent No.3 by issuing an appropriate legal notice within a period of three weeks from today and respondent No.3 may be directed to consider and decide the same, within a reasonable time.

Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, including the issue of MUKESH KUMAR SALUJA CWP No.26178 of 2014 -2- 2014.12.19 17:50 I attest to the accuracy and authenticity of this document limitation, if any, lest it should prejudice the rights of either of the parties, Commandant, Army Recruitment Office, ARO, Patiala-respondent No.3, is directed that if the petitioner approaches him by moving an appropriate legal notice within a period of three weeks from today, he shall consider and decide the same at an early date, by passing an appropriate order thereon, strictly in accordance with law, but in any case within a period of six weeks from the date of receipt of legal notice from the petitioner.
