ap C.R.M. 6067 of 2016 In the matter of: an application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 29.07.2016 in connection with Gazole Police Station Case No. 344 of 2016 dated 13.06.2016 under Sections 498A/307/326/34 of the Indian Penal Code.

And In re.: Soneka Sarkar @ Rajbanshi & Anr. .... Petitioners.

Mr. Musharraf Alam Sk. ... for the petitioners

Mrs. Kumkum Mitra. ... for the State.

The petitioners, apprehending arrest in connection with Gazole Police Station Case No. 344 of 2016 dated 13.06.2016 under Sections 498A/307/326/34 of the Indian Penal Code, have come to this Court for anticipatory bail.

Heard the learned counsel appearing on behalf of the parties. The petitioners are the mother-in-law and the brother-in-law (husband of the sister-in-law). The father-in-law is on bail.

The learned counsel of the petitioners claims that the petitioners and the father-in-law, who is now on bail, are standing on the same footing, such fact has not been disputed by the learned counsel of the State.

We have gone through the case diary and find no valid reason to take a different stand.

Having regard to above, the petitioners' prayer for anticipatory bail is allowed on parity.

2

In the event of arrest, the petitioners shall be released on bail to the satisfaction of the arresting officer upon furnishing Bond of Rs.5,000/- each on condition that after release, they shall surrender before the court concerned within four weeks thereafter.

This order is subject to the conditions laid down in sub-section (2) of Section 438 of the Code of Criminal Procedure.

The application for anticipatory bail is, thus, disposed of.
