This order shall dispose of 84 above mentioned Regular RFA No.4218 of 2011(O & M) 18 First Appeals arising out of one common impugned Award dated 01.10.2009.
These appeals have been filed by the State of Haryana challenging the impugned award of the reference Court, Faridabad, on the ground that market value of the acquired land has been determined on the higher side There is a delay of 180 days in filing and 267 days in re- filing these appeals. Noticing the fact that the Department had received the certified copies of the impugned award along with the opinion of the Legal Remembrancer, Secretary to Government of Haryana, for filing the appeal, well within time and still there was unexplained delay in filing as well re-filing of the appeal, this Court passed the following order on 03.08.2011:
Present: Mr. Ashish Gupta, AAG, Haryana There is a delay of 180 days in filing these appeals. A perusal of the averments made in the applications would show that the certified copies of the impugned Award dated 01.10.2009 along with the opinion of the District Attorney and the instructions of the Legal Remembrancer & Secretary to Government Haryana had reached the Advocate General's office for filing of the appeals well within time and even the Advocate General Haryana office had informed the concerned Department for sending the necessary documents for filing the appeals in this Court and the said communication was received by the office of the Land Acquisition Officer Urban Estate, Haryana on 17.12.2009 but appeals could be filed before this Court only on 14.07.2010 and the same were refiled on RFA No.4218 of 2011(O & M) 19 18.07.2011 after a further delay of 267 days in refiling.
Let the file pertaining to the filing of these appeals of the office of LAO, Urban Estate, Faridabad and the communications sent by the AG office, Haryana to the aforesaid office be produced in this Court, for perusal.

03.08.2011 (RAKESH KUMAR GARG) JUDGE Thereafter, on 08.08.2011, the following order was passed:
Present: Mr.Ashok Jindal, Additional Advocate General, Haryana These appeals have been preferred by the State of Haryana challenging the award of the Reference Court on the ground that the market value of the acquired land has been determined on the higher side.
On 03.08.2011, the following order was passed:
"There is a delay of 180 days in filing these appeals. Let the file pertaining to the filing of these appeals of the office of LAO, Urban Estate, Faridabad and the communications sent by the AG office, Haryana to the aforesaid office be produced in this Court, for perusal.

Sh.Ashok Jindal, learned Additional Advocate General, Haryana, who is present in Court has submitted that the Advocate General Office has already communicated the order dated 03.08.2011 to the concerned officials. However, no one has contacted him to give instructions in this regard. Neither anybody is present.
From the aforesaid attitude of the officials of the State of Haryana, it is crystal clear that not only the officials are negligent and casual in their approach to defend the state cases but they are also showing defiance to the Court orders to produce the record, which is causing the delay in disposing of the RFA No.4218 of 2011(O & M) 21 land acquisition cases for determination of compensation of the acquired land.
Before proceeding further, let a notice be issued to the Land Acquisition Collector, Urban Estates, Faridabad to explain his conduct. He is also directed to be present in Court along with the record on the next date of hearing.
List on 23.08.2011.
Let an explanation of the Director, Urban Estate and Financial Commissioner-cum-Secretary, Urban Estate, Haryana be also filed.
Photocopy of this order be placed on the files of each connected case.
No explanation of the Director, Urban Estate and Financial Commissioner-cum-Secretary, Urban Estate, Haryana, is filed in pursuance of the aforesaid order, however, today, Mr.Bir Singh Kaliraman, Land Acquisition Collector, Faridabad is present in the Court along with the records. However, from the record, he could not explain the administrative exigencies because of which delay of 267 days in re-filing this appeal has occurred, neither the delay in filing the appeal could be explained.
In these circumstances, this Court finds no grounds to condone the delay in filing as well as re-filing these appeals. Prayer is rejected.
Since applications for condonation of delay in filing as well as in re-filing the appeals have been rejected, the appeals are also dismissed being time barred.
