ORDER
Hon'ble Dr. Anand S. Khati, Member (A) By virtue of the present Original Application (O.A.) filed under Section 19 of the Administrative Tribunals Act, 1985, the applicants are seeking the following reliefs:-
"(i) Allow this Original Application.
(ii) Issue necessary orders to set-aside & quash the impugned order OM F.No. 7/3/2023-CS. 1(A) dated 30th October, 2023 issued by CS-1 Division, Deptt. of Personnel & Training referring DOPT OM No. A-
51/1/2023-Ad.I dated 09.10.2023 & OMs issued by concerned respective Departments of applicants in compliance thereto, viz. OM No.A-51/2/2023-Ad.I dated 19th December,2023 & dated 21st December, 2023 issued by DOP&T; OM No.A-20002/29/2022- Ad.I dated 31.10.2023 issued by M/o SΠ OM No.91-17/2023-Admin (DOP) dated 18.12.2023 issued by Deptt. of Post and OM No. A-
50013/161/2023-Admn.dated 21 December, 2023 issued by M/o Jal Shakti & similar other issued by respective Departments of applicants based on common advice/opinion of DOP&T.
(iii) Direct the respondents to issue appropriate order extending the coverage for Old Pension Scheme under C.C.S. (Pension) Rules, 1972 (now 2021) to the applicants in terms of Department of Pension & Pensioner's Welfare OM No. 57/05/2021-P&PW (B) dated 03.03.2023 complying with all other formalities as detailed therein.
(iv) Direct the respondents to stop further recoveries from salary of the applicants towards contributions to New Pension Scheme & credit the accumulated contributions collected so far to respective General Provident Fund Accounts of the applicants.
(v) Direct the respondents to recover subscriptions towards GPF contribution and crediting these to the respective GPF Accounts of the applicants under G.P.F. Rules.

(vi) May also be pleased to pass any further order(s) as deemed just and proper in the facts & circumstances of the case."
2. The brief facts of the case as narrated by the learned counsel for the applicants are as under:
2.1 The applicants were selected as Assistants (now ASOs) in the Central Secretariat Service (CSS) against vacancies originally earmarked for filling through CGLE-2004, which were notified by the Staff Selection Commission (SSC) on 18.10.2003--prior to the introduction of the National Pension Scheme (NPS) on 22.12.2003. The said notification dated 18.10.2003 included the post of Assistants in various cadres including CSS, and was issued for the purpose of recruitment through CGLE-2004. The DoP&T vide its letter dated 15.10.2003 had confirmed its participation in CGLE-2004, and subsequently reported 389 vacancies for the Select List Year 2004 in the CSS cadre.
2.2 Due to administrative delays in reporting the vacancies by the cadre units to the SSC, the posts could not be filled through CGLE-2004. Instead, SSC, with the consent of DoP&T, carried forward the said vacancies to be filled through CGLE-2005.
Importantly, the SSC advertisement for CGLE-2005 dated 23.07.2005 contained a specific note that explicitly excluded the 35 Item No. 90 (C-5) O.A. No.305/2024 post of Assistant in CSS from the said examination, thereby reaffirming that the vacancies filled through CGLE-2005 were not newly advertised, but were in continuation of the 2003 notification.
2.3 Pursuant to the Office Memorandum dated 03.03.2023 issued by the Department of Pension & Pensioners' Welfare (DoP&PW), which allowed a one-time option for coverage under the CCS (Pension) Rules, 1972 (now 2021) for posts advertised prior to 22.12.2003, the applicants submitted representations seeking such coverage. The OM clearly provides that employees appointed against posts notified before the introduction of NPS may opt for coverage under OPS, irrespective of their date of actual appointment. As the applicants were appointed against the 389 vacancies originally notified on 18.10.2003, they exercised this one-time option, which was, however, rejected by CS-I Division, DoP&T vide order dated 30.10.2023 on the ground that they were selected through CGLE-2005.
2.4 Learned counsel for the applicants contended that such denial is arbitrary and discriminatory, especially as similarly situated employees in other Ministries, including Defence, Railways, and the Ammunition Factory have been extended OPS 36 Item No. 90 (C-5) O.A. No.305/2024 benefits on the same ground, i.e., based on the date of notification of posts, not the date of examination or appointment. 2.5 The applicants further relied upon the DoP&T's internal communications, including letters dated 15.10.2003, 30.09.2005, and the Annual Report of 2005-2006, all these, according to them, confirm that these appointments pertain to the Select List of 2004.
2.6 The applicants have also cited binding precedents, such as:
(i) Judgment dated 02.02.2021 passed by the Hon'ble Delhi High Court in the case of Dilip Kumar Singh & Ors. vs Union of India & Ors. in W.P.(C) No. 1037/2020 and batch;
(ii) Order dated 20.03.2023 passed by Single Bench of this Tribunal in OA No. 3735/2018 in the case of Narender Kumar Yadav vs UOI & Ors.; and
(iii) Order dated 15.02.2016 passed by Ernakulam Bench of this Tribunal in Sheeba B & Anr. vs Union of India & Ors.

Opposing the grant of relief, learned counsel for the respondents submitted that the applicants were selected through SSC CGLE-2005, for which the notification was issued on 23-29 July 2005, well after the cut-off date of 22.12.2003, as prescribed 37 Item No. 90 (C-5) O.A. No.305/2024 under the notification introducing the New Pension Scheme (NPS). He further submitted that although DoP&T had confirmed its participation in CGLE 2004, the vacancies for Assistant posts in Central Secretariat Service (CSS) could not be reported in time, and, hence, no recruitment to CSS was made through CGLE-2004. The vacancies that arose and could not be filled in CGLE 2004, were subsequently carried forward and reported to SSC only in May, 2007 for filling through CGLE-2005, after collecting and finalizing the data from various cadre units. 3.1 Learned counsel for the respondents contended that the 389 vacancies, which the applicants are relying upon, were neither notified nor advertised in the CGLE-2004 notification, and thus cannot be relied upon to claim coverage under the Old Pension Scheme. The applicants were selected against the vacancies notified and advertised only in 2005, and their appointment letters were issued much later, after the introduction of the NPS. Hence, their claim for OPS is factually incorrect and legally untenable.
3.2 The learned counsel for the respondents further contended that judgments relied upon by the applicants pertain to cases where the entire recruitment process, including notification, had 38 Item No. 90 (C-5) O.A. No.305/2024 commenced prior to 01.01.2004, which is not the case here. In the present case, no such notification or advertisement existed for CSS vacancies in CGLE-2004, and therefore, the recruitment process for the applicants commenced only in 2005. 3.3 Learned counsel for the respondents also pointed out that the O.A. is barred by limitation, as no application for condonation of delay has been filed, and the applicants have approached this Tribunal after an inordinate and unexplained delay.

In rejoinder to the arguments put forth by learned counsel for the respondents, learned counsel for the applicants reiterated that the 389 vacancies were, in fact, part of the CGLE-2004 cycle, supported by DoPT's own documents, including letters dated 15.10.2003 and 30.09.2005, and the Annual Report of 2005- 2006, which referred to these posts as belonging to the Select List of 2004. Learned counsel for the applicants also argued that under the OM dated 03.03.2023, the determining factor is the original date of vacancy notification and not the examination or appointment year. He further submitted that all the applicants exercised their one-time option before their respective cadre units, in line with the OM dated 05.09.2023, which designated the concerned Ministry/Department as the competent authority. 39

5. Heard the learned counsel for the respective parties and perused the pleadings/judgments on record.

On a thoughtful consideration of various judgment/orders passed by the Hon'ble High Court/Tribunal relied upon by the applicants in support of their claim, we find that in the batch case of Dilip Kumar Singh & Ors. (supra), the advertisement/ notification was issued in September, 2003, June, 2003 and November, 2003, i.e. prior to coming into force the present contributory pension scheme on 22.12.2003 and the court was of the view that the petitioners cannot be deprived of the benefit of the Old Pension Scheme. However, the same cannot be applied to the facts of the present case, since the advertisement was issued post 22.12.2003.
7. Similarly, in OA No. 3735/2018 in the case of Narender Kumar Yadav (supra), the process of recruitment started well before 01.01.2004. Rather, to be specific, the process of recruitment started when the respondents requested the employment exchange for advertisement, i.e. on 11.12.2003, but in the present case, data was collected and the vacancies were advertised only in 2005. Also, in the case of Sheeba B & Anr. vs Union of India & Ors., wherein it has been held that for the 40 Item No. 90 (C-5) O.A. No.305/2024 purpose of OPS coverage, the determining factor is the date of notification of the post not the recruitment cycle or date of joining, which is also a distinguishable factor in the present factual matrix of the case.
8. The existence of a vacancy or the occurrence of a vacancy may be a germane factor for determining the crucial date relevant to the vacancy year or to arrive at the conclusion that applicant(s) are to be extended the benefit of OM seeking conversion from NPS to OPS, but that by itself is not conclusive proof that an aspirant shall also be entitled to be appointed to the said post on that date of occurrence of vacancy as a matter of right. Even otherwise, assuming that there was a vacancy for the subject posts, whether it can be assumed that it would have automatically created a valuable right in favor of the applicant(s) for assuming that an actual vacancy arose on or before 22.12.2003 without going to the actual date of notifying/advertising or going through the prescribed process of recruitment/selection. Even a candidate, who is selected and included in the merit list, has no indefeasible right of appointment, even if the vacancy exists.
9. On perusal of correspondence(s) sought to be relied upon by the learned counsel for the applicants, it can be said that the 41 Item No. 90 (C-5) O.A. No.305/2024 process of recruiting Assistants was mooted in the year 2003, but it was only in the year 2005 when the posts were advertised. The advertisement is silent on the issue as to whether the vacancies so notified pertained only to the year 2003 alone. There cannot be any presumption under the law that the vacancies were confined to those that existed prior to 22.12.2003 only. It has not been disputed by the learned counsel for the applicants that the applicants did not apply in the advertisement issued in the year 2003 as they did not fulfill the eligibility conditions for the post of Assistant in the year 2003, but only after 2004. However, the learned counsel for the applicants submitted that the aspect of eligibility is not in question, but the interpretation of Clause 4 of the OM dated 03.03.2023 is the issue to be determined.
10. It is trite law that the more absurd a suggested conclusion of construction is, the more the Court will lean against that conclusion. That is ordinarily so whether one is construing a contract or a statute. [See: Hatzl v. XL Insurance Co. Ltd. (2009) EWCA Civ. 223].
11. The Apex Court in K.P. Varghese vs Income Tax Officer, Ernakulam and Another, (1981) 4 SCC 173, has held as follows:

No.305/2024 "6. .....It is now a well-settled rule of construction that where the plain literal interpretation of a statutory provision produces a manifestly absurd and unjust result which could never have been intended by the legislature, the court may modify the language used by the legislature or even "do some violence" to it, so as to achieve the obvious intention of the legislature and produce a rational construction (vide Luke v. Inland Revenue Commissioner [(1963) AC 557] )....."
12. Further, the Apex Court in Bishwajit Dey vs The State of Assam in Criminal Appeal No.87 of 2025 vide Judgment dated 07.01.2025 has recently held as under:-
"25. The presumption against absurdity is found in the brief observation of Lord Saville agreeing with his colleagues in the case of Noone [R (on the application of Noone) v. Governor of HMP Drake Hall [2010] UKSC 30]. Lord Saville says simply:
"I would allow this appeal. For the reasons given by Lord Phillips and Lord Mance, I have no doubt that by one route or another the legislation must be construed so as to avoid what would otherwise produce irrational and indefensible results that Parliament could not have intended." "
13. We fail to appreciate that such an argument put forth by the learned counsel for the applicants regarding eligibility is not an issue that is the core issue in order to come to a conclusion about whether Clause 4 of OM dated 03.03.2023 could, in a remote sense, be applied to the applicants herein, who were not eligible on the crucial date on or before 22.12.2003.

14. There is no ambiguity in Clause 4 of the OM dated 03.03.2023, which clearly stipulates that persons who were recruited for posts or vacancies advertised or notified before 22.12.2003. Neither were the vacancies notified or advertised prior to 22.12.2003 nor was there any material on record to establish that the Advertisement issued in 2005, pursuant to which the applicants applied, was in continuation of the advertisement in the year 2003. The present case is not a case of inter-se seniority or promotion, but a case of a recruitment process, the parameters of which are distinct and separate. The occurrence and filling of vacant posts are a continuous process until vacancies are notified or advertised; no valuable rights accrue in favor of aspirants. It cannot be, by any stretch of imagination, said that the applicants were appointed/recruited to vacancies that existed prior to the notification dated 22.12.2003. There is no lineage to the earlier advertisement in 2003 to the latter one to which the applicants applied and participated in the selection process.
15. In Vijay Kumar Mishra and Anr. vs High Court of Judicature at Patna, reported in AIR 2016 SUPREME COURT 3698, the Apex Court observed as under:

Item No. 90 (C-5) O.A. No.305/2024 "11) In my view, there lies a subtle distinction between the words "selection" and "appointment" in service jurisprudence. (See : Prafulla Kumar Swain vs. Prakash Chandra Misra & Ors., (1993) Supp. (3) SCC
181).
When the framers of the Constitution have used the word "appointed" in clause (2) of Article 233 for determining the eligibility of a person with reference to his service then it is not possible to read the word "selection" or "recruitment" in its place. In other words, the word "appointed" cannot be read to include the word "selection", "recruitment" or "recruitment process".

13) It is a settled principle of rule of interpretation that one must have regard to subject and the object for which the Act is enacted. To interpret a Statue in a reasonable manner, the Court must place itself in a chair of reasonable legislator/author. So done, the rules of purposive construction have to be resorted to so that the object of the Act is fulfilled. Similarly, it is also a recognized rule of interpretation of Statutes that expressions used therein should ordinarily be understood in the sense in which they best harmonize with the object of the Statute and which effectuate the object of the legislature. (See-Interpretation of Statues 12th Edition, pages 119 and 127 by G.P.Singh)."

The applicants in the instant case were selected through SSC CGLE-2005, for which the notification was issued on 23-29 July 2005, i.e. well after the cut-off date of date of 22.12.2003, as prescribed under the notification introducing the National Pension System (NPS). Although DoP&T had confirmed its participation in CGLE 2004, the vacancies for Assistant posts in the CSS could not be reported in time; hence, no recruitment to CSS to the post of Assistant was made through CGLE-2004 and 45 Item No. 90 (C-5) O.A. No.305/2024 those vacancies were subsequently carried forward and reported to Staff Selection Commission in May, 2007 only for filling up through CGLE-2005 after finalizing the data from various cadre units, which cannot confer any right upon the applicants to claim the benefit of OM dated 03.03.2023.
17. For the reasons discussed hereinabove, we find that the present O.A. is devoid of any merit and the same is accordingly dismissed. Pending MAs, if any, also stand disposed of. However, there shall be no order as to Costs.
