					ORDER

"Instead of terming the members of the petitioner-Association as 'Land Encroachers', they have to be called 'Land Grabbers', who are before this Court by way of this Writ Petition".

The petitioner-Association has come forward with this Writ Petition praying for issuance of a Writ of Certiorari to call for the records of the first respondent in proceedings in G.O.Ms.No.649, dated 29.12.2003, Revenue (Ni.Mu.1(1)) Department and quash the same.

At the time of hearing the case, I have posed a question to the learned counsel for the petitioner that, as the issue involves the question of 'encroachment of the land', the matter needs to be heard by a Division Bench, to which learned counsel for the petitioner submitted that the abovesaid G.O. in G.O.Ms.No.649, dated 29.12.2003, Revenue (Ni.Mu.1(1)) Department, is under challenge and if the matter if referred to Division Bench, and if any adverse orders are passed by the learned Single Judge, the right of Intra-Court Appeal would be deprived to the parties.

3. It is the averment of the petitioner that the petitioner-Association is registered under the Societies Registration Act with Registration No.416/90 and it consists of 97 members. According to the petitioner-Association, its members are in possession of the property comprised in Survey No.333, Velacherry Village, Mambalam-Guindy Taluk, Chennai. The members of the petitioner-Association approached the Government for grant of Patta in respect of the land under their respective possession. The first respondent passed order in G.O.Ms.No.862, Revenue Department, dated 07.08.1992, wherein each member of the petitioner-Association was allotted one cent in respect of the land comprised in the said S.No.333. It is further stated that the third respondent has granted Patta to the members of the petitioner-Association and the members have been in possession and enjoyment of the land by putting up superstructure and Asbestos shed under their respective possession. It is further stated that the Government had acquired the lands by G.O.Ms.No.15, Revenue Department, dated 12.01.2000 for the purpose of MRTS, Phase-II Scheme and in the said G.O., there is no reference about the requirements of the land comprised in S.No.333. The land comprised in S.No.333 is measuring 4 acres 87 cents. The third respondent prepared a lay-out and as per the lay-out, 1 acre 50 cents were allotted to the members of the petitioner-Association. The remaining lands in the said Survey Number vest with the Government. It is the stand of the petitioner-Association that the land assigned to its members is not required for MRTS, Phase-II Scheme.

It is further stated by the petitioner-Association that at the instance of the third respondent and Railway Officers, the Corporation of Chennai, on 07.06.2001, caused demolition notice to the members of the petitioner-Association, leading to the filing of a Civil Suit in O.S.No.2963 of 2002 on the file of the City Civil Court, Chennai, against the first respondent and others. In the said suit, an application was filed in I.A.No.8581 of 2002 for interim injunction against the respondents herein and others. The said suit itself is filed for permanent injunction. In the said suit, the respondents 1 to 3 are represented by the Government Pleader, City Civil Court, Chennai. In the said suit, the Civil Court granted interim injunction on 29.08.2003 in I.A.No.8581 of 2002. During the pendency of the said suit, the third respondent has issued a notice on 25.07.2003 under Section 7 of the Tamil Nadu Land Encroachment Act, to all the members of the petitioner-Association, whereby the possession of the said land had been termed as unauthorised occupation by the members, and the members of the petitioner-Association gave reply to the said notice. The petitioner-Association through its President, made a representation to the second respondent on 08.08.2003 vindicating their right and sought redressal of their grievance. The second respondent did not take action on the said representation. Thereafter, the third respondent issued notice under Section 6 of the said Act, subsequent to which, the members of the Association gave a representation on 03.10.2003. The petitioner-Association came to understand that the first respondent, by the impugned G.O.Ms.No.649, Revenue Department, dated 29.12.2003, has cancelled G.O.Ms.No.862, Revenue Department, dated 07.08.1992, which fact was known to the members of the petitioner-Association only on 16.04.2004 through external hands who are trying to dispossess the members of the petitioner-Association from the land. The first respondent had not issued any notice to the members of the petitioner-Association before cancelling the said G.O.Ms.No.862. On enquiry, it came to be known to the members of the petitioner-Association that, as the lands under occupation of the members, are required for MRTS, Phase-II Scheme, the first respondent has cancelled the said G.O.

It is the further stand of the petitioner-Association that in the impugned G.O.Ms.No.649, dated 29.12.2003, it has been referred that the entire extent of 4.67 acrs of land, was earlier assigned to the members of the petitioner-Association, which is factually incorrect. The third respondent has allotted 1.50 acres of land to the petitioner-Association and the remaining land vests with the Government. It is the claim of the petitioner-Association that the land under occupation of the petitioner is not required for MRTS Phase-II Scheme, as is evident from G.O.Ms.No.15, Revenue Department, dated 12.01.2000.

That apart, the Civil Suit was pending and that there was interim order granted in the suit in I.A.No.8581 of 2002 in O.S.No.2963 of 2002 and the same is in force when the impugned G.O. was passed. Without application of mind, a decision has been taken and the first respondent ought to have noticed the above fact. It is the stand of the petitioner-Association that its members are entitled to 1.50 acres and not the entire extent of 4.57 acres of the land covered under the said G.O.Ms.No.862, dated 07.08.1992. According to the petitioner-Association, the action of the first respondent in cancelling G.O.Ms.No.862, is in violation of Articles 14 and 21 of the Constitution of India and that the impugned G.O.Ms.No.649 has got to be interfered with and that there shall be a declaration that the impugned G.O. is bad in law.

7. During the pendency of this Writ Petition, the respondents 4 to 6 have been impleaded. This Court, in W.P.M.P.No.14471 of 2004, on 30.06.2004, granted an order of interim stay of the impugned order, and to vacate the same, the respondents 1 to 3 have filed W.V.M.P.No.2195 of 2004. The said interim order of stay was made absolute by this Court, by order dated 01.11.2006. The second respondent-District Collector, Chennai has filed counter affidavit along with the said vacate stay petition, stating that the Government land in S.No.333 of Velacherry Village was initially encroached by 97 persons unauthorisedly, who formed an Association in the name and style of "Annai Indira Gandhi Hut Dwellers Welfare Association". On the representation of the said Association (writ petitioner), the Government, in their G.O.Ms.No.862, Revenue Department, dated 07.08.1992, issued orders to assign the land in S.No.333 in favour of 97 persons who were the members of the Association, either free of land cost or after the collection of land value based on the merit of each case, after changing the classification of the land from "Meikkal Poramboke" to "Natham". In the counter affidavit, the second respondent-District Collector relied on the PLR extract of the land, which reads as follows:

It is further stated by the second respondent-District Collector in the counter that based on the directions issued in the G.O. necessary proposals were called for from the Tahsildar, Mambalam-Guindy Taluk. The Government accepted the request of the petitioner-Association in principle to assign 1 cent of land each in S.No.333 to 97 persons. In the meantime, the Tahsildar issued patta to 312 persons instead of 97 persons without any formal orders of the Government/Collector.

In furtherance, the second respondent contended that show cause notice was issued to the entire 312 persons for cancellation of patta issued to them, in which 97 persons being the members of the petitioner-Association were also included. It is submitted that all the aggrieved 312 persons filed a suit in O.S.No.1495 of 1997 against the notice of the Collector and no interim order of stay was granted in the said suit and the second respondent/District Collector, Chennai, after observing all formalities, cancelled the Pattas issued by the Tahsildar to 312 persons including the said 97 persons of the petitioner-Association under the provisions contained in RSO 31(8), vide proceedings No.J5/12705/97, dated 19.04.1997. Against the said order of the Collector, the petitioner-Association filed W.P.No.10400 of 1997, which was dismissed by this Court on 08.07.1997. Further, no assignment orders were issued in accordance with the above G.O., as the land was requisitioned for Railway purpose, and as such, the encroachers have no right over the land.

10. Added further, it is stated in the counter that the above land in S.No.333 is in need of implementation of MRTS Project Phase-II, by the Railway Department for common public purpose. The Government in G.O.Ms.No.649, dated 29.12.2003 issued orders and cancelled G.O.Ms.No.862, Revenue Department, dated 07.08.1992, in which the petitioner-Association's 97 members were ordered to be issued 1 cent each, after observing all formalities. Aggrieved by G.O.Ms.No.649, Revenue Department, dated 29.12.2003, the petitioner-Association filed suit in O.S.No.2963 of 2002. Pending suit, the petitioner-Association filed I.A.No.8581 of 2002 in O.S.No.2963 of 2002 and the City Civil Court, Chennai, allowed the said I.A. by order dated 29.08.2003.

It is further averred in the counter that the Tahsildar of Mambalam-Guindy Taluk issued notice under Section 7 of the said Act on 02.08.2003 to all the members of the Association and the same was served on them. Suppressing the above facts before this Court, the petitioner-Association filed the present Writ Petition. Further, the Government in G.O.Ms.No.862, Revenue Department, dated 07.08.1992 have issued orders to assign the land in S.No.333 of Velacherry Village in favour of 97 members of the petitioner-Association, of 1 cent each, either at free of land cost or after the collection of land cost, whereas, the petitioner-Association failed to restrict its members strength from 97 to 312. The then Tahsildar issued Patta in favour of 312 members as against the original strength of 97 members and also without any orders from the Government/Collector. The land in question is a Government Poramboke land. Subsequently, the Government, in G.O.Ms.No.649, Revenue Department, dated 29.12.2003, cancelled their earlier G.O.Ms.No.862, dated 07.08.1992. The Government alone have rights over the interest of the disposal of the Government land and as an encroacher, the members of the petitioner-Association have no rights to establish their claim as owners of the land which belongs to the Government.

It is the further stand of the second respondent-District Collector in the counter affidavit that the Writ Petition filed by the petitioner-Association is not maintainable, when a big Railway project work is taken into consideration for implementing the same in large scale and for common public cause, as the extent of land and the course of project and the involvement of lands required cannot be decided at the initial stage itself. Therefore, it is not possible to determine at the time of issuance of G.O. that whether the lands allotted to the members of the petitioner-Association are going to be acquired for the implementation of MRTS Phase-II work.

It is the further stand of the second respondent in the counter that the notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905, was served on the members of the Association on 02.08.2003 and after opportunity of hearing, Form-6 was issued on 03.10.2003 as per the provisions laid down in the Rules in force. The MRTS, Phase-II project is an important common public project work by the Railway Department, which is much affected by the hurdles from the petitioner-Association, and steps have been taken to evict them from the Government land which was in order. The entire land in S.No.333 of Velacherry Village is a Government land and meant for the implementation of the MRTS Project Phase-II by the Railway authorities, which is for the use of general public. The eviction process got completed only after observing all formalities as per the Rules in force, by the authorities. The petitioner-Association and its members were given ample time and opportunity to protect their belongings. It is stated that the land in question has been handed over to the Special Tahsildar, MRTS, Phase-II in vacant possession on 28.06.2004, and in turn, the Special Tahsildar, MRTS handed over the land to the Railway authorities on the same day itself. All the members of the petitioner-Association, except Deivayani, Lakshmi and Suseela Dhananjayan, have occupied the land in question unauthorisedly by encroaching upon the land. Because of the interim order, the entire project work in Velacherry Terminal point has been completely paralyzed and could not be completed, even though the funds were allocated for the purpose. Unless the interim order granted by this Court is vacated, the project work could not be completed, as the land in dispute is required for Velacherry Terminal for developing circulating area and service road. Moreover, the project is only for greater public purpose and the second respondent prayed for dismissing the Writ Petition by vacating the interim order dated 30.06.2004.

14. Pending the present Writ Petition, the Railways have been impleaded as respondents 4 and 5 on 17.07.2009 in W.P.M.P.No.439 of 2009. Learned counsel for the respondents 4 and 5 submitted that the affidavit filed in support of the impleading petition in W.P.M.P.No.439 of 2009, may be treated as counter affidavit filed by respondents 4 and 5. In the said affidavit filed by the then Deputy Chief Engineer-I/Metropolitan Transport Project (Railways), Southern Railway, Chennai, it is stated that the lands comprised in S.No.333 of Velacherry Village, Mambalam-Guindy Taluk, are classified as Government Poramboke. Initially, there was a proposal to grant Patta in respect of the said lands to various encroachers who have occupied the said lands totalling to 97 in number, resulting in issuance of G.O.Ms.No.862, Revenue Department, dated 07.08.1992. In the meanwhile, the then Tahsildar had committed serious irregularity in issuing Patta to 312 persons as against 97 persons for whose benefit the Government Order was issued and the said Pattas were issued by the then Tahsildar even before before the procedural formalities for allotment were completed. All the Pattas were issued without the formal orders of the Government/Collector and the then Collector of Chennai issued show cause notice to 312 persons to whom the Pattas were erroneous issued by the Tahsildar, calling upon them to show cause as to why the same should not be cancelled. O.S.No.1495 of 1997 was filed challenging the said notice and as no interim order was granted, the Pattas issued by the Tahsildar to the said 312 persons including the said 97 persons, were cancelled by duly observing all formalities under the provisions contained in R.S.O.31(8) under proceedings No.J.5/12705, dated 19.04.1997. Challenging the same, W.P.No.10400 of 1997 was filed before this Court, which was dismissed on 08.07.1997. It is further stated that the subject lands were also handed over to the Railways by the Revenue Authorities.

In the meantime, the Mass Rapid Transit System (MRTS) Project was introduced, which is jointly being implemented by the State Government and the Railways and the subject lands which are classified as Government Poramboke, are very much required for the said project, more particularly, the approach to the Velacherry Railway Station, as the said lands abut the Velacherry Railway Station. In such circumstances, as the project is a public utility programme, which is of great importance to the travelling public, the members of the petitioner-Association are to be evicted, as they are encroachers. Accordingly, notice was issued under the Tamil Nadu Land Encroachment Act to all the occupants on 02.08.2003. In the meanwhile, the petitioner-Association filed O.S.No.2963 of 2002 before the City Civil Court, Chennai and obtained interim order in I.A.No.8581 of 2002, restraining the Revenue Authorities from dispossessing them and the same forms the basis for interim order being granted by this Court in the present Writ Petition on 30.06.2004.

16. It is further stated in the counter filed on behalf of the respondents 4 and 5 that by judgment and decree dated 10.07.2006, the said suit in O.S.No.2963 of 2002 was dismissed for default. The subject lands are near the Velacherry Railway Station Building and some third parties, who are neither the said 97 members whose names are found in G.O.Ms.No.862, dated 07.08.1992, nor the said 312 members for whom the Pattas were erroneously issued by the Tahsildar, which were cancelled under proceedings dated 19.04.1997, have started putting up shops with pucca RCC buildings abutting the approach roads to the Railway Station. Originally, 97 members were allotted 1 cent of land for residential purpose only and not for commercial use. Moreover, a new 18 M width road from Perungudi to Velacherry connecting Velacherry-Tambaram Road, is also under execution as part of this project, which culminates near the Velacherry Station Building. The lands in question are sandwiched between the newly formed main road and the approach roads to the Station. Hence, these lands are essentially required for the Railways for the over-all infrastructural development works.

17. Heard both sides and perused the materials available on record.

18. Pending Writ Petition, this Court, by order dated 30.06.2004 in W.P.M.P.No.14471 of 2004, has granted an order of interim stay. Subsequently, in W.V.M.P.No.2195 of 2004 and W.P.M.P.No.14471 of 2004, on 01.11.2006, the interim order of stay granted on 30.06.2004, was made absolute. The Writ Petition is being disposed of after a period of 11 years.

It is not in dispute that there is a G.O. in G.O.Ms.No.862, Revenue Department, dated 07.08.1992, by which, 97 members of the petitioner-Association, were allotted 1 cent each, for the purpose of having house-sites. The then Tahsildar, in a clandestine manner, has issued Pattas to 312 persons instead of 97 persons without any formal orders of the Government/Collector. A show cause notice dated 12.03.1997 was issued by the second respondent/District Collector, stating as to why the assigned Pattas to 312 persons should not be cancelled. After hearing the parties, the second respondent-District Collector, on 17.04.1997, had cancelled the Pattas given to 312 members including the said 97 members of the petitioner-Association. As against the cancellation of patta, the petitioner-Association filed an appeal before the Commissioner of Land Administration, in which, the cancellation of Pattas granted in favour of 312 persons, was upheld on 02.07.1997. When the said appeal was pending before the Appellate Authority, namely the Commissioner of Land Administration, W.P.No.6278 of 1997 was filed by the petitioner-Association challenging the said cancellation of Pattas. The said Writ Petition was dismissed for non-prosecution on 28.07.1997.

20. When the members of the petitioner-Association were disturbed without assigning any lands, in order to protect the members of the petitioner-Association, a Civil Suit in O.S.No.2963 of 2002 was filed before the City Civil Court, Chennai, for permanent injunction restraining the defendants from interfering with the possession and enjoyment of the members of the petitioner-Association in S.No.333. The petitioner-Association also filed interlocutory application in I.A.No.8581 of 2002 in O.S.No.2963 of 2002 for interim injunction restraining the defendants from interfering with the possession and enjoyment of the members of the petitioner-Association. The said I.A. was allowed granting interim injunction on 29.08.2003. Thereafter, on 24.09.2003, the Tahsildar had issued notice under Section 6 of the Tamil Nadu Land Encroachment Act, by treating the occupation of the members of the petitioner-Association as unauthorised. The petitioner-Association sent reply dated 05.10.2003 stating that the members are not unauthorised occupants and that the Civil Court has granted interim order mentioned supra. It is further stated that the Civil Court's order was in force and the proceedings initiated for removal of encroachment, is contrary to the order passed by the Civil Court and that the order of the Court shall be obeyed.

The further case of the petitioner that in utter disobedience to the order of the Civil Court, the impugned G.O.Ms.No.649, Revenue Department, dated 29.12.2003 has been issued, cancelling the earlier G.O.Ms.No.862, Revenue Department, dated 07.08.1992. The reason given in the impugned G.O. is that the land is required for Velacherry MRTS project and that the petitioner-Association had not obtained any order of injunction in their favour and therefore, the earlier G.O.Ms.No.862 whereby lands in S.No.333 were allotted to the members, was cancelled. But the fact remains that the Civil Court had earlier granted interim injunction on 29.08.2003 in I.A.No.8581 of 2002 in O.S.No.2963 of 2002. In the impugned G.O.Ms.No.649, in paragraph 4, it is stated that there is no interim order in the said suit. That apart, in this Writ Petition, this Court, on 30.06.2004, has granted interim order of stay of the impugned G.O. and the same was confirmed by this Court on 01.11.2006. The sum and substance of the interim order passed by this Court is that the members of the petitioner-Association shall not be disturbed from their possession and enjoyment of the property on the presumption that the lands have been allotted/assigned to the members of the petitioner-Association for the purpose of domicile/residence.

Even though the Government wanted to allot the lands for the purpose of constructing a dwelling unit to the said 97 members of an extent of 1 cent each to the members, there is no assignment of land and the land was illegally assigned to 312 persons, in which, 97 members were also parties, and this was cancelled by the impugned G.O. and the cancellation has become final. Admittedly, the members of the petitioner-Association are encroachers.

The contention of the learned counsel for the petitioner that the members of the petitioner-Association have not been given hearing either before or after the cancellation of the G.O., is not acceptable, as the opportunity of hearing may not arise at all, since the need for hearing is required only if the members are assigned the land. The Government has not allotted any land to any of the members of the petitioner/Association and the assignment of land given to 97 members along with others, totalling to 312, had been cancelled by the Collector on the ground that the Tahsildar has no powers and that the Tahsildar had assigned the Pattas surreptitiously and that the cancellation has also been upheld by the Appellate Authority. As long as the lands are Poramboke lands and that no assignment is given to the members of the petitioner-Association, as on date, and, on and from the date of cancellation of assignment by the District Collector, the petitioner-Association has no locus-standi to continue in the lands.

That apart, the lands have been given to Railways, as could be seen from the counter affidavit of the second respondent/District Collector, wherein it has been averred that the lands in question have been handed over to the Special Tahsildar, MRTS, Phase-II project, in vacant possession, on 28.06.2004 and in turn, the Special Tahsildar, MRTS had handed over the lands to the Railway authorities on the same day itself.

From the pleadings, it is clear that the members of the petitioner-Association have usurped the properties and only after interim order of Court, by making the Court to believe that they were in occupation, the members of the petitioner-Association have come with unclean hands duping this Court and obtained order, and on this score alone, the members of the petitioner-Association are not entitled to the relief sought for in this Writ Petition. The entire issue is proceeded on the basis that the members of the petitioner-Association have right of occupation and that they shall not be disturbed. First of all, there is no evidence that the members of the petitioner-Association were in possession of the property. Even assuming it so, after the cancellation of Pattas, the members have no right. Moreover, having unsuccessfully obtained orders, squatting in the properties for more than a decade, is completely illegal. The Supreme Court has come down heavily with regard to the encroachment of the Government lands, which are meant for public purpose. The contention of the learned counsel for the petitioner that there is no counter affidavit by the Railways and they have produced certain documents without any supporting affidavit, can't be accepted. In this regard, learned counsel for the respondents 4 and 5 submitted that the affidavit filed in W.P.M.P.No.439 of 2009 in W.P.No.12383 of 2004, filed by the then Deputy Chief Engineer-I/Metropolitan Transport Project (Railways), Southern Railway, Chennai, may be treated as counter affidavit of respondents 4 and 5.

26. Subsequent to the order of this Court, dated 04.10.2017, inspection of the properties, was conducted by the respondent-authorities. In the inspection report, it has been categorically stated the commercial buildings have come up. It is stated that third parties have encroached upon the properties in question. It is the contention of the petitioner-Association that as on date, the lands have not been assigned to them and that if the impugned G.O. is interfered with, they would get 97 cents of land and that they are willing to demolish the commercial structures and ensure that the the property is used for residential purpose only.

27. When this Court posed a question to the learned counsel for the petitioner that has any land been sold by any of the members of the petitioner-Association, it has been stated that none of the members of the petitioner-Association have sold the properties and that they are residing there. But however, there is no evidence produced before this Court to show that the members of the petitioner-Association are residing there.

28. When the buildings have not been allotted to the members of the petitioner-Association, they have no right over the properties, neither residential building nor commercial building can stand in the place meant for Railways. That apart, learned Government Advocate appearing for the respondents 1 to 3 and 6 produced documents and Compact Disc, along with the inspection report, which makes it clear that pucca building has been constructed and commercial buildings have also come up to an extent of several thousands of square feet. The inspection was conducted on 11.11.2017. The inspection report submitted by the sixth respondent-Tahsildar, Velacherry Taluk, as per the order of this Court, dated 04.10.2017, reads as follows:

" 1. I, T.Murali s/o Teekaram (late) aged about 42 years working as Tahsildar, Velachery Taluk having office at No. 113, V.V.Koil street, Tharamani, Chennai  600 113 solemnly affirm and sincerely state as below:
2. It is respectfully submitted that in the above writ petition, the Honble High Court of Madras in the order dated 04.10.2017, have ordered the all the respondents are directed to inspect the sites in question along with the petitioner Associations counsel, on similar lines of the order dated 10.12.2009, after informing the persons who are occupying the place and take photograph and video graph of the inspection and submit a detailed report in line with the said order dated 10.12.2009. The respondents are directed to complete the exercise on or before 05.11.2017 and submit a report by 10.11.2017.
3. It is respectfully submitted that the survey and inspection of the land in survey number 333, Velachery Town, Velachery Taluk was conducted abiding with all the instructions as directed by the Honble High Court. The detailed report from the earlier stages before the formation of Annai Indira Gandhi Hut Dwellers Welfare Association is submitted below:
4. It is respectfully submitted that during the initial stages of 1982, the Government land in Survey No. 333 of Velachery village measuring an extent of 4.87 acres and classified as Meikkal Poramboke vested with Government. There were encroachments in this land in S.No.333 and they were removed by Corporation of Chennai. Therefore the aggrieved encroachers formed an association in the name style of Annai Indira Gandhi kudisai Valvore Nala urimai Sangam and approached the Honble High Court. The Honble High Court in the order dated 15.12.1988 and 02.01.1989 in two different writ petitions have directed to consider the representation of the petitioner Sangam for assignment of 1 cent land to the 97 members of the Association.

It is submitted that subsequently one Thiru Manivel, President of Annai Indira Gandhi Kudisai Valvore Nala Urimai Sangam requested the Government to assign land in Survey No. 333 of Velachery village to 97 members of the said Association. Considering the orders of the Honble High Court, the Government in G.O.Ms.No.862 Revenue (A1) Department Dated 07.08.1982 directed the Collector to take necessary action to assign the land in Survey No. 333 to 97 members of the said Association at the rate of one cent each, either free of land cost or collection of land value based on the merit of the land from Meikkal Poramboke to Natham.
6. It is submitted that based on the Government order, the then Tahsildar, Mambalam  Guindy Taluk submitted the proposals on 10.03.1993 along with a copy of the proposed lay-out. Meanwhile, the Highways Department (TNUDP) requested to transfer 1 acre and 2 cents of land out of total extent of 4.64 acres in S.No. 333/1 for road widening and a portion of land in Survey No. 333/1 has already been utilized by the Highways Department for Road widening. Subsequently the Government in G.O.(Per) No. 303 Revenue Dated 18.04.1994 have leased out an extent of 10,000 sq.ft in S.No.333 to Indian Oil Corporation initially for a period of 3 years for putting up a retail outlet by sub-dividing the land as 333/2. Thereupon the extent of Survey No. 333/1 was 4.64 acres and 333/2 was 0.23 acres. Therefore, the then Tahsildar, Mambalam  Guindy Taluk had sent a revised proposal on 08.05.1995 with a fresh layout for the assignment of land to 97 persons in Survey No. 333/1. The land was vacant on ground without any habitation. The extent of land in Survey number 333 was furnished by the Tahsildar in the report as below:

7. It is submitted that no final decision was taken by the Collector for assigning 1 cent of land to 97 members of the Association. In the meantime, one Thiru Harikrishnan, Tahsildar, Mambalam  Guindy Taluk in his proceedings No. A2/ 3975/ 1993 dated 10.02.1997 had issued patta to 312 individuals one cent each and issued patta extracts in Form  II- 10(1) extract to all the 312 individuals assignment patta Nos. from 7756 to 8062. The issue of assignment pattas were brought to the notice of District Collector and he issued show cause notice to the assignees since the pattas issued by the Tahsildar were not in accordance of law. After obtaining their replies, the Collector cancelled the assignment of house sites issued to all the 312 persons vide his proceedings J5 / 12705/ 1997 dated 17.04.1997. Moreover, the Collector of Chennai has held that in Chennai District, the Taluk Tahsildars are not competent to assign Government lands nor competent to grant ryotwari pattas by changing the classification of land from Government poramboke to Ryotwari manai. Then the petitioner Sangam filed Revision petition before Commissioner of Land Administration, Chennai600 005. However, the orders of the Collector of Chennai in J5/ 12705/1997 dated 17.04.1997 was upheld by the Commissioner of land administration vide his proceedings No. D.Dis 13548/ 1997 (F1) Dated 02.07.1997.
8. It is submitted that in the meantime, requisition for the entire 4.87 acres of land in Survey No. 333 of Velachery village was given by MRTS to the Collector of Chennai. Therefore, a proposal was sent to Commissioner of land administration that the entire land in Survey No. 333 of Velachery village 4.87 acres may be given to MRTS thereby cancelling the G.O.Ms. No. 862, Revenue Department Dated 07.08.1992 and also recommended that the affected family may be given allotments from Tamil Nadu slum clearance Board. Therefore, the Government in G.O. (perm) No. 649 , Revenue (L.Dis 1(1)) Department dated 29.12.2003, have cancelled the G.O.Ms.No.862, Revenue Department Dated 07.08.1992.
9. It is submitted that the land in Survey No. 333/2 of Velachery village measuring an extent of 0.23 acres was resumed from IOC and the lease was also cancelled. Under urgency clause, based on the representation from MRTS, the lands in Velachery village Survey No. 333/1 measuring an extent of 4.64 acres and in Survey No. 333/2 measuring an extent of 0.23, total land measuring an extent of 4.87 acres have been handed over to the Special Tahsildar (LA), MRTS on 28.06.2004. The Government in G.O.(Perm) No. 510, Revenue (L.Dis.4(2)) Department dated 01.09.2005 ordered that the lands in Velachery village Survey Nos. 333/1 and 333/2 measuring a total extent of 4.87 acres were leased out to MRTS and a nominal lease rent of Rs.1000/- levied per annum was fixed as lease rent.

It is submitted that the Honble High Court of Madras in the order dated 10.12.2009 in the above writ petition have ordered among other things appointed an Advocate Commissioner and directed that the Tahsildar, Mambalam-Guindy Taluk along with Surveyors have to survey the property viz 97 cents allotted to 97 persons in Survey No.333, Velachery village and file a report. In the order, it was also stated that the Tahsildar, Mambalam-Guindy taluk with the help of the Revenue Inspectors have to locate and identify 97 cents allotted to 97 persons and prepare sketch and submit it before the court. The Tahsildar is also directed to find out what type of buildings are constructed in the property and the new construction which is coming up. The team of officials has to verify whether the 97 people are there in the property and the list of persons who are presently occupying in 97 cents. The Tahsildar is also directed to find out whether any encroachment has been made in excess of 97 cents which has been assigned to 97 persons pursuant to the G.O.Ms.No.852, dated 07.08.1982. Thus it has been directed that the Tahsildar has to file a report along with the sketch on 22.12.2009 with notes of Inspection and the list of persons. Accordingly, the said report was filed by the Tahsildar before the Honble High Court on ...............

It is submitted that as directed by the Honble High Court by an order dated 04.10.2017 in the Writ Petition directed that a fresh inspection of the land of 97 cents occupied by the Writ Petitioners be taken up in the presence of the District Collector, Chennai, Commissioner, Greater Corporation of Chennai and other officials and report submitted before the Honble Court on or before 10.11.2017. In compliance with the order of the Honble High Court a joint inspection was fixed on 04.11.2017 but it could not be gone through due to heavy rains on that day. And the factual report in this regard was submitted on 09.11.2017 to the Special Government Pleader, High Court for placing before the Court. Therefore another date for enumeration as well as inspection as directed by the Court was fixed on 11.11.2017, 6.30a.m. after forming 8 teams of officials from the Revenue, Survey and Greater Chennai Corporation and the fact of which was publicized in the locality door to door through the Revenue Inspector. A notice was also sent through the Revenue Inspector for service on the Writ Petitioner represented by its president Mr.Thananjayan and as he could not contacted and since others refused to receive the notice, it was served by the Revenue Inspector by affixture on the wall of the residence belonging to K.Sundaramoorthy said to be the Secretary of the Association. It is submitted that thereafter the inspection and enumeration was taken up on 11.11.2017 in the presence of the District Collector, Chennai, District Revenue Officer, Chennai, Revenue Divisional Officer, Chennai South and the Zonal Officer, Zone XIII, Greater Chennai Corporation and other officials along with the team of police in accordance with the directions of the Honble High Court and the enumeration details in the format, the location sketch and field sketch along with compact disc (CD) containing the video graph and photos taken during the course of enumeration are submitted herewith. As per enumeration, there are now only 22 occupants as against the 97 reported in 1992. Irrespective of the fact that there are only 63 units the number of occupants rose to 176 as detailed below :

It is humbly prayed before the Honble High Court that It was ascertained out of the above most of the present encroachers are using the land exclusively for commercial purpose. Only 2 are using the subject land exclusively for residential purpose. Non of the rest are being used for residential dwelling. It is enlighten from the enumeration that the land is predominantly put to use for commercial purposes only by way of garages, mechanic sheds (two and four wheelers), fish market, fabrication units, grocery shops and the like in the guise of occupying smaller portions for cooking and dwelling purposes. In other words, the land is being exploited squarely for commercial purposes only for furthering their business activities. I therefore submit that the land has to be handed over to the MRTS Railways as it serves a greater public cause, after vacating the occupants of the land. I herewith enclose team wise (8 teams) enumeration reports, location sketch and field sketch along with Compact Disc (CD) containing the video graph and photos for kind reference. I humbly pray that the facts may be appraised by the Honble Court and render justice."

30. From a reading of the above tabular columns, for instance, this Court refers one or two documents to show the Bird's eye view about the encroachment. Along with the inspection report, the details of the allottees, possession, etc., are extracted supra. For example, the extent of land said to be with one Thangaraj who is a member of the petitioner-Association, is 0.00.39.5 Sq.M. and the commercial building had come up and he has rented out the premises for Rs.30,000/- and that the allottee is not in possession and it is some other person. Similarly, with regard to another allotment, it is seen that one Sundaramoorthy and Alamelu are building owners and that the age of the building is 10 years and the building is used both for residential and commercial purpose and in the building, there are ground floor + two floors and the extent of land is 0.02.36.5 Sq.M. Similarly, it is pointed out one Meenakshi, Wife of Saravanan is using the building for commercial purpose, by running Arunachala Guest House and the extent of the land therein is 0.00.94.0 Sq.M. and in respect of that property, the first owner is one Harichandran, who had sold out the property to Mr.Subrayan, who in turn sold the property to Mrs.Meenakshi and now they are running commercial building and the electricity connection is in the name of the previous owner and that the owner is not residing in that place. Similarly, one Ismail Gani is the owner of the place, who is not residing and the usage of the building is commercial and there are ground floor + 2 floors and there is a Mosque in that place.

31. On a Bird's eye view on the inspection report produced, it is clear that the subject lands alleged to have been claimed by the members of the petitioner-Association, are not for residential purpose alone and more places are also used for commercial purpose. Admittedly, as stated supra, after the order of the Collector, the assignment of land had been cancelled, which has been confirmed by the Commissioner of Land Administration, which has attained finality and the Government has not issued any order in favour of any one of the members of the petitioner-Association allotting any land, much less 1 cent of land each, for residential purpose, and squatting in the properties, is illegal and the land grabbers can't be shown any indulgence by anyone, much less by the Court. If this Court is coming to the rescue of the members of the petitioner-Association, then it is like this Court also perpetuating the illegality.

32. The contention of the learned counsel for the petitioner that subsequent developments need not be taken into account and the issue with regard to the veracity of the impugned G.O. alone be tested, is not acceptable. The Court will have to see the subsequent developments also, as the lands are meant for public purpose. It is the contention of the learned counsel for the respondents 4 and 5/Railways that subsequent to the interim order of this Court passed in this Writ Petition on 30.06.2004, again, all the evictees once again occupied the lands. Even assuming that the Court will have to restrict only with regard to the impugned G.O., then also, the petitioner-Association will have to fail, as the Government had decided not to assign the lands to the members of the petitioner-Association and that they are encroachers by squatting on the properties and they have prevented the development of the Project in question. From the photographs and videograph produced, it is clear that the members of the petitioner-Association have caused hindrance for the development of the MRTS Project. Those who have prevented the development of our Country, by means of any introduction of any Project, they can be called "Land Grabbers".

33. Further, the Zonal Officer (in-charge) of Zone-XIII of the Corporation of Chennai, has filed a report dated 27.11.2017 stating that the survey was directed to be conducted by order dated 10.12.2009 of this Court and this Court further directed the Commissioner of Corporation to depute local Corporation Officials to assist the Tahsildar and his team in locating the properties in 97 cents. Subsequently, a fresh inspection was conducted based on the basis of the order of this Court dated 04.10.2017 and eight Corporation Officials have been deputed to assist the Revenue Authorities during inspection. The inspection was conducted on 11.11.2017. It is further stated in the said report of Zonal Officer of the Corporation that the lands in S.No.333 belong to Revenue Department and the same are not belonging to the Corporation of Chennai.

34. Further, the Chennai Metropolitan Development Authority, by letter dated 31.01.2001, has already addressed to the authorities that the petitioner-Association has put up construction unauthorisedly and it was decided at the Co-ordination Committee meeting that Corporation of Chennai be requested to take action for stopping the same. It is seen that there is unauthorised construction in S.No.333, and that no Pattas had been issued to the encroachers. Even though the petitioner-Association wanted to impress upon the Court by communication of the Metropolitan Transport Project (Railways) Chennai, dated 09.01.2008, addressed to the District Collector, Chennai that the land in question in S.No.333 is earmarked for CMDA's future development, it is clear from the subject column of the said communication, dated 09.01.2008 that the house has been demolished and removed for handing over to MRTS. The entire MRTS Project has to be developed by High Level Co-ordinating Committee consisting of CMDA and others and that the CMDA and others are Nodal Agency. Hence, the contention that the land vested with the CMDA and not Railways, may not be correct.

35. Learned counsel for the petitioner relied on a decision of the Supreme Court reported in 2010 (11) SCC 557 (Manohar Lal Vs. Ugrasen) to contend that in exercise of inherent jurisdiction under Section 151 CPC, in the event of coming to the conclusion that a breach of an order of restraint which had taken place, it may bring back the parties to the same position as if the order of injunction has not been violated. In the case on hand, there is no violation of any order and that the order passed by the Civil Court in the suit mentioned supra, is not to disturb the petitioner during the pendency of the Writ Petition. But it is very unfortunate that after the order of this Court, the members of the petitioner-Association have entered into the properties and when there is no order for construction, even the commercial constructions have been made and it is stated that some of the members have even sold the property when it has not actually devolved upon them. It is for the Inspector General of Registration, Chennai, to ascertain as to how many properties have been sold with the connivance of the office of the Sub-Registrar and several hands have been changed. When the properties have not been allotted to the members of petitioner-Association by the impugned G.O., if any sale had taken place, then departmental action has got to be initiated against the concerned Sub-Registrar who has registered documents in respect of the properties in question belonging to the Railways. That apart, it is not a bar to also initiate criminal action against the sellers and buyers and bring the issue to a logical conclusion. The petitioner-Association has not produced any document to show that the buildings have been constructed after taking prior permission from the authorities concerned. This Court is of the view that every member of the Government service shall all times maintain absolute integrity, devotion to duty and shall do nothing which is unbecoming of a member of the Government service. In the case on hand, if any of the Officials, including the Sub-Registrar is responsible for registering any sale deed or document, they shall be dismissed from service.

36. Learned counsel for the petitioner also relied on a decision of the Supreme Court reported in 2007 (11) SCC 374 (All Bengal Excise Licensees' Association Vs. Raghabendra Singh) and contended that where in violation of a restraint order or an injunction order against a party, something has been done in disobedience, it will be the duty of the Court as a policy to set the wrong right and not allow the perpetuation of the wrong doing. The Apex Court held that the inherent power will not only be available under Section 151 CPC, and it is also to be exercised in that manner in the interest of justice and public interest.

37. In the present case on hand, there is no violation or disobedience committed by any of the official respondents with regard to the entire order passed by the Civil Court and this Court, which proceeds on the basis that the members of the petitioner-Association were in occupation and they shall not be disturbed from the place. After obtaining the order, they started squatting on the properties and in any event, when there is stay of the impugned G.O. by this Court, which is the subject matter of the present Writ Petition, I am of the view that there is no interim order operating against the respondents from issuing fresh G.O. or from taking appropriate action for evicting the encroachers. The members of the petitioner-Association has no right to claim as a matter of right to stay in the properties, as the Pattas issued to 97 persons, had been cancelled, which has been confirmed by the Commissioner of Land Administration.

38. Learned counsel for the respondents 4 and 5/Railways relied on a decision of this Court reported in 2015 Supreme Madras 1230 (in W.P.No.5537 of 2015, dated 05.03.2015 - K.Ramachandra Kurup Vs. Secretary to Government Revenue Department and four others), wherein it is held that when the lands are Poramboke lands, which are classified as Voikal Poramboke and Meikal Poramboke, which has not been utilised, the same could not have been recommended for assignment. In the said decision, this Court has further held that at one point of time, the Revenue Department has considered the request made by the petitioner therein and made certain recommendations, but however, there is no document produced to show that the petitioner therein has been granted permission to enter upon the land, and therefore, the alleged possession of the petitioner therein is unauthorised and illegal. In the case on hand, in the absence of any assignment as on date, there is no semblance of legal right for the members of the petitioner-Association to enter into the lands. At no point of time, after the order of the Collector, the members of the petitioner-Association had a right to continue in the properties of the Railways. The contention of the learned counsel for the petitioner that there is no separate G.O. handing over the lands to the Railways, may not be correct.

39. Learned counsel for the respondents 4 and 5/Railways also relied on a decision of a Division Bench of this Court reported in MANU/TN/0913/2002= 2002 Writ L.R. 577 (Bharath Rathna Dr.B.R.Ambedkar Educational Trust Vs. Union of India and 4 others, in Writ Appeal No.1162 of 2002, dated 19.06.2002), wherein the Division Bench held as follows:

"THE NECESSITY AND PURPOSE OF ACQUISITION:
7. The purpose of acquisition as stated above being undoubtedlyfor the larger interest of the entire society should prevail and outweigh the claims of the petitioners. It does not require citing of precedents to state the well accepted proposition of law that public interest should prevail over individual interest or of a small group and that the individual interest should give way and is sub-servient to the larger public interest. The petitioner/Trust which claims to plead for the downtrodden section of the Society should appreciate that MRTS is intended more for the benefit of the working class and community. Well-to-do citizens, who can commute the distance by four wheelers, two wheelers and hired vehicles like Taxi or Autorickshaw, have no need to travel in the electric train. MRTS is intended only to the benefit of the poor sections of the society and the need to manage the chaos and confusion in the city traffic is also emergent. Therefore,the plea that the appellants belong to downtrodden community and that they should oppose the scheme is self-contradictory and irrational.

THE RIGHT BY ADVERSE POSSESSION AND ESTOPPEL:

14. This claim is stated only to be rejected. When once it is admitted that the land is poromboke or public land and the occupant is only an encroacher, the first and foremost requirement to prescribe adverse title namely, the assertion of animus of exclusive title as against the true and lawful owner, is totally absent. They have themselves been frequently pleading for an alternative site from the Government. Hence, the plea of adverse possession cannot at all be entertained. As regards estoppel, no materials are placed before us to prove any promise by the competent authority of the Government to the effect that the occupants would be allowed to remain therefor all times to come in future and they will not be disturbed irrespective of any public need arising in future."

40. Further, in terms of Revenue Standing Orders, namely RSO.21, relating to assignment of house site in villages and towns, Appendix-XIX therein prescribes the form of order of assignment of house sites and certain conditions are prescribed thereunder and only after following those procedures, the Government land can be assigned. In this case, as on date, there is no order of assignment and a plea is made to the effect that the members of the petitioner-Association may get assignment, but they are trying to continue in the properties. The Commissioner of Land Administration has directed that when Government wanted to assign the land to anyone, they have to follow RSO.21. Admittedly, RSO.21 has not been followed in this case. Believing that the assignment procedures will be followed and the members of the petitioner/Association may get 1 cent of land each, the petitioner-Association has approached this Court. The petitioner-Association has no locus-standi to maintain either the suit or the Writ Petition. The suit filed by the petitioner-Association in O.S.No.2963 of 2002 before the City Civil Court, Chennai, was dismissed for default on 10.07.2006 The contention of the learned counsel for the petitioner that on the face of the interim order of the Civil Court, the impugned G.O. has been issued, cannot be accepted for the detailed discussion made above.

41. When the allegations are made against Railways that no counter affidavit has been filed by the Railways and the impugned G.O. has been passed without hearing the petitioner, admittedly, on the date of filing of the Writ Petition, the Pattas were cancelled and that fact has not been brought to the attention of this Court. This Court is of the view that the petitioner-Association has come forward before this Court with unclean hands. Since this Court finds that that there is no case made out by the petitioner, much less prima-facie case, it is open for the respondents 4 and 5 / Railways to take the lands in question allotted to the Railways, within a period of 15 days from the date of receipt of a copy of this order, and in that process, they shall seek the assistance of the respondents 1 to 3 / Government and the Police concerned.

42. Further, this Court is of the view that the principles of natural justice has not been violated in this case. It is also incorrect to state that in view of the interim order of the Civil Court, the impugned G.O. had been passed. It is stated that on 28.06.2004, symbolic possession has been given to the Railways. Moreover, the suit in O.S.No.2963 of 2002 was dismissed for default on 10.07.2006. No proceedings either before this Court or before the Civil Court, have prevented the Government from issuing the G.O. or any other proceedings and allot the lands to the Railways.

43. Further, the Supreme Court has categorically observed in the decisions reported in 1983 (3) SCC 333 = AIR 1983 SC 622 = MANU/SC/0054/1983 (Dr.Vijay Kumar Kathuria and another Vs. State of Haryana and others) and 1994 (1) LW 21 (SC) = 1994 (1) SCC 1 (S.P.Chengalvaraya Naidu Vs. Jagannath) and also this Court in the decision reported in 1993 (1) MLJ 26 = 1992 Writ L.R. 716 (V.Tamil Selvan Vs. The State of Tamil Nadu) that the person who has to approach the Court, must come with clean hands; otherwise, no relief could be granted to that person. In the present case, there are suppression of facts and that the members of the petitioner-Association have no right to the property belonging to the Railways.

44. For the reasons stated above, the petitioner-Association is not be entitled to the relief sought for. Accordingly, the Writ Petition is dismissed. No costs.

45. This Court makes it clear that if there are any genuine persons who are likely to be affected and whose properties have not been referred to in the inspection report of the respondents, they may be considered for assignment of lands in a different place, and if any person has converted the place into that of commercial units, need not be considered, and it is open for the respondents/Government to consider the request of the members of the petitioner-Association to allot any other place of the choice of the Government, but this will not give them a right to stay in the properties in question on the ground that till another place is allotted, they will continue in the same place. If any such contention is raised, the members of the petitioner-Association are not even entitled to any alternative place also.

46. Before parting with this case, it is to be noted that during the hearing of the present Writ Petition, the petitioner-Association has filed an affidavit dated 01.02.2018 along with letter/complaint dated 01.02.2008 addressed to the Hon'ble Chief Justice, stating that I should recuse from hearing the present Writ Petition. The matter has already been argued at length and only at the request of the petitioner, sitting was there for two days after 5 p.m. that had last for nearly two hours each day. It is pointed out that there are lots of encroachments and in the light of Order 18 Rule 18 CPC, this Court made observations and that if there is prima-facie case, the Court is also empowered to inspect the site in question to ascertain the correctness of the report. As it is stated that commercial complex had also been constructed in the place allotted to the members of the petitioner-Association, and if there is any inspection, this Court may cull out more details as to who is residing in the place and whether there is any sale of the property, etc. The conversation made by this Court between the petitioner's counsel and the respondent's counsel, had been extracted in the said letter/complaint of the petitioner addressed to the Hon'ble Chief Justice. The Apex Court has held that it is open for the Court to pose questions or suggest settlement to give a quietus to the matter, more particularly in the light of mediation/conciliation, etc. The entire arguments have been addressed in this matter and I have earlier observed that if required, the matter will be posted for further hearing. After going through the documents and the photographs/videograph, it throws light about the illegal buildings being constructed in the lands given to the Railways for MRTS, Phase-II Project. This Court has decided not to go for any inspection and fearing inspection, such communication has been addressed. Moreover, during the pendency of this Writ Petition, the authorities have inspected the place in question and have filed inspection report, which has been discussed supra.

47. With regard to the submission of the petitioner that I should recuse myself from hearing this case, more particularly, when arguments have been completed, and only a decision needs to be taken as to whether the places in question have got to be inspected to ascertain the correctness of the videograph/photographs, it is to be observed as stated supra, that I have to discharge my duties based on the Oath taken and I have to be true to the said Oath taken. That apart, fearing that if I visit the places in question, not only the factum of the petitioner-Association having not been allotted one cent of land, but also that commercial complexes have come up, would come to light and that some of the persons, without even a title to the property, have sold the property, which had been clandestinely registered, to take out the matter from the list, the affidavit, dated 01.02.2018 has been filed by the petitioner and also enclosing the letter, dated 01.02.2018, addressed by the petitioner to the Honourable Chief Justice.

48. In this case, I have never shown any partiality to anyone and if the decision is rendered in favour of the petitioners, certainly, it would amount to partiality in favour of the petitioner, as from the facts discussed supra, the violators/Land Grabbers who are trying to squat in the properties from 2003 and did not want anyone to render a decision against the person who has no benefit of the impugned G.O.Ms.No.649. There is no question of "bias" in this case. Ultimately, it is for the Judge to decide as to whether I should recuse from hearing the case or not, and no one can compel a Judge to recuse from hearing the case, when the Judge has nothing personal in the matter and posing of questions during the arguments, is only by way of clarification and naturally, even during the course of hearing, the Court will have to pose questions, so that the party should not be put to any prejudice. Hence, the decisions relied on by the petitioner in the said affidavit, dated 01.02.2018, reported in 2011 (8) SCC 380 (Justice P.D.Dinakaran Vs. Honourable Judges Inquiry Committee and others), 1998 (5) SCC 513 (State of West Bengal and others Vs. Shivananda Pathak and others, etc.) and 1987 (4) SCC 611 (Ranjit Thakur Vs. Union of India and others), are distinguishable on facts.

49. It is to be further noted that this Court is empowered to ask any question or make any observations, and ultimately, the judgment alone will speak. The petitioner who is said to have given the complaint to the Hon'ble Chief Justice, amounts to interference with the Judiciary. Any Judge can express the view in the Open Court and ask questions by way of clarification. Whether the letter/complaint, dated 01.02.2018, given by the petitioner to the Hon'ble Chief Justice, would amount to Contempt or not, is for the Hon'ble Chief Justice to take a decision. No one can compel a Judge to recuse from a case and I have to discharge my duties based on the Oath taken, more particularly in the light of the term "fear or favour".
