WRIT PETITION No. 5341 of 2002
ORDER:
1. When this matter is taken up for hearing, none appeared for the petitioner in spite of the fact that this writ petition is listed under the caption "for dismissal".
2. The petitioner filed this writ petition seeking a writ of mandamus declaring the action of the respondent in not sanctioning the benefits under the Voluntary Retirement Scheme vide B.P Ms.No.282, dated 30.1.1999 as arbitrary, illegal and violative of Article 16 of the Constitution of India, and to direct the respondent-Board to pay a sum of Rs.1,52,370/- being the sum equivalent to 270 days salary as per the VRS as approved by the respondent-Board with interest.
3. The case of the petitioner is that he obtained voluntary retirement in pursuance to the scheme announced by the respondent-Board vide BP Ms.No.282, dated 30.1.1999. The grievance of the petitioner is that full benefits under the said Scheme were not extended to him.
4. Having regard to the circumstances of the case, this Court is of the view that this writ petition can be disposed of directing the petitioner to submit a representation within a period of two weeks from the date of receipt of a copy of this 2 order. On such representation being received, the respondent shall pass appropriate orders.
5. Accordingly, the Writ Petition is disposed of directing the petitioner to submit a representation within a period of two weeks from the date of receipt of a copy of this order. On such representation being received, the respondent shall consider the same and pass appropriate orders within a period of four weeks thereafter. No costs. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
