2. Writ Petition No. 6313 of 2018 is not on board. Upon mentioning, taken on board.
3. Rule. Rule made returnable forthwith by consent of the parties, the group of writ petitions is taken up for final disposal.
4. This group of writ petitions raises common questions and arises out of almost similar facts. Writ Petition No.527/2025 (Original WP/4418/2016) is transferred from the Nagpur Bench to this Bench i.e. Aurangabad Bench, and clubbed together with other writ petitions by Administrative Order dated 06/11/2025 passed by the Hon'ble Administrative Judge. Rule was granted in WP/527/2025 by order dated 03/09/2018. Thereafter, notices were again issued to all the parties and they were served as per office report.
5. Inspite of service, none appears for the Respondent Nos. 5(a) to 5(e)- in respective Zilla Parishads in WP/527/2025.
6. The petitioners, in all these writ petitions, are the persons appointed from time to time under the Pradhan Mantri Gram Sadak ( 75 ) WP-527-2025 + Yojana (PMGSY, for the sake of brevity) in the year 2007 till 2012, as per the dates specifically mentioned in the respective writ petitions. The petitioners were appointed to various posts. The petitioners have now approached to this Court seeking creation of posts and for permanency benefits with the contention that since 2007 or their respective date of appointment, they have been continuously working till date, except for technical breaks given only for the purpose of denying the benefits of permanency.
7. It is the case that the scheme continued though subsequently, the name of the scheme was changed to Mukhyamantri Gram Sadak Yojana (MGSY). Thereafter, it was again re-named as Pradhanmantri Gramin Sadak Yojana (PGSY, for the sake of brevity). Though the names have been changed, the work remained the same and the staff also remained the same. All the petitioners are paid from Government funds. Initially the scheme was implemented through Zilla Parishad, and now a society i.e. Maharashtra Rural Development Agency (MRDA) is formed by the Government of Maharashtra, wherein the Members are the Secretary ( 76 ) WP-527-2025 + level officers of various Departments and it is this Society -MRDA under which the petitioners are presently working.

In the above facts, the learned Advocate Mr. Pankaj Kumar, appearing in WP/527/2025, makes the following submissions that, the petitioners were appointed by following due process of law and by creating the posts. All these posts are substantive posts. Attention is invited to the advertisements issued by the Zilla Parishad for appointment of persons on various posts. The first advertisement was published by the Zilla Parishad, later on the advertisements were issued by the Maharashtra Rural Development Agency (MRDA) under the PMGSY. It is the State who pays the salary. Respondent No.2 - Maharashtra Rural Roads Development Association (MRRDA) was brought into picture by Government decision dated 08/05/2003. Though the constitution of controlling agency has changed, the work remained the same. The funding is done by the Union of India (Central Government). The scheme is now extended till 2047. The nature of work is thus permanent. The work is continuous in nature. Only to deprive the ( 77 ) WP-527-2025 + petitioners from the benefits of permanency, artificial breaks are given, though the work continuous uninterrupted. Now, the scheme is named as Mukhyamantri Baliraja Panand/Raste Yojana as of 14/12/2025 with the same employees. He thus submits that, for all the purpose, the petitioners are practically permanent employees. He further submits that now, the Government has taken a decision on 04/11/2025 thereby the persons from health scheme taken only for the scheme under the Health Department are now given the permanent status. He submits that the posts are vacant in the Zilla Parishad where all the petitioners can be absorbed and no creation of posts is required for that purpose.
9. In support of his submission, he relied upon the following judgments:
(i) Vinod Kumar and Ors. Vs. Union of India and Ors.1;
(ii) Jaggo Vs. Union of India and Ors.2;
(iii) Dharam Singh and Ors. Vs. State of U.P. and Anr.3;
10. Learned Advocate Mr. Dayanand Mali, appearing for petitioners in respective Writ Petitions, adopted the arguments of learned Advocate Mr. 1 (2024) 9 SCC 327 2 2024 SCC OnLine SC 3826 3 Passed by Hon'ble Apex Court in CA/8558/2018 dated.19.08.2025.
( 78 ) WP-527-2025 + Pankaj Kumar. He submits that when the petitioners were appointed, they were placed on pay scale of 5500-9000. He further submits that in his case also the vacancies are lying vacant with the Zilla Parishad. He invited attention to the minutes of meeting of Rural Development Department dated 10/07/2010 to substantiate his argument that for all the purposes the vacancies are permanent and the nature of work is permanent.

The learned Advocate Mr. Avinash Deshmukh, appearing in WP/4465/2015 and 4992/2015, submits that in the year 2010, total 1091 posts were created and those were treated at par with the regular employees. He submits that for the same work extracted through outsourcing, higher salaries are paid, whereas the petitioners who have been working for a long time, are continued on the same salary which was granted to them at the time of their appointments without any additional benefits. This amounts to discrimination and unfair treatment. He thus prays that the petition deserves to be allowed.

12. It is submitted that the Welfare Government is not expected to exploit persons like petitioners. He invited attention to the selection process that was conducted while giving appointment to the petitioners. The eligibility of any of the petitioners is not disputed. There is no dispute that they were appointed by following due process of law. He relied upon the judgment in the case of Sheo Narain Nagar and Ors. Vs. State of Uttar Pradesh and Ors.4
13. Learned Advocate Mr. Kulkarni appearing in WP/4130/2015 and WP/4125/2015, adopted the arguments of earlier Advocates. Learned Advocate Mr. D. S. Bagul appearing in WP/6536/2015 and WP/6529/2015, also adopted the arguments of other Advocates in other Petitioners. He relied upon the Government Resolution dated 31/07/2018.
14. The learned Advocate Mr. Mohit Deshmukh, appearing in WP/4591/2015 and WP/5270/2015, adopted the argument of earlier Advocates. He also submits that the posts were created with pay scales clearly showing that the petitioners were appointed like any other 4 2018 AIR (SC) 233 ( 80 ) WP-527-2025 + Government Employees. He submits that a Committee was constituted for recruitment and appointment of the petitioners and that their appointments cannot be termed as backdoor entries. They are paid Traveling Allowances (TA) and Dearness Allowances (DA) corresponding to pay scale. The technical breaks are given at regular intervals only to deprive the petitioners of permanency benefits. He relied upon the judgments in the case of Ajay Hasia and Ors. Vs. Khalid Mujib Sehravardi and Ors.5 and judgment passed in Writ Petition No.2046/2010 (Nagpur Bench). He thus submits that the petitions deserve to be allowed.
15. He relied on the judgment in the case of Ajay Hasia and Ors. (supra), while countering the argument of respondents that no writ can be issued against society. He submits that in the present case, the society is totally controlled by the Government, and therefore, is a State under Article 12 of the Constitution of India.
16. Opposing the petitions, the learned Senior Advocate Mr. V. D. Sapkal, appearing in all these writ petitions, except WP/527/2025, 5 (1981) 1 SCC 722 ( 81 ) WP-527-2025 + submits that the entire record shows that the petitioners were necessarily appointed under a scheme. When the petitioners are appointed for a particular scheme, they cannot claim permanency or regularization. Their services are only till the scheme is over. The salary is paid from the funds allotted to the scheme. He took this Court to the prayer clauses and submits that no claim of regularization with the State is made. If the petitioners are seeking appointment in the Government service, they must approach the Maharashtra Administrative Tribunal.
17. On merits, he submits that in the advertisements itself, it is clearly stated that the appointments are under the PMGSY scheme on contractual basis. The petitioners having accepted the contractual appointments, cannot now turn around and seek permanency. No writ is prayed against the Zilla Parishad. The advertisement is only for one year. The work is now done under the different schemes. There is no challenge to such policy in the petitions. There is no work now available of permanent nature. He relied upon the judgment in the case of Secretary, State of Karnataka and Ors. Vs. Umadevi and Ors. 6, where it is 6 2006 AIR (SC) 1806 ( 82 ) WP-527-2025 + held that no right can be created of regularization. He relies on the reply filed in WP/4130/2015, common in all the writ petitions. He submits that the establishment of MRRDA, which is a Society registered under the Societies Registration Act. The said society though is established by the Government cannot be said to be an instrumentality of the State under Article 12 of the Constitution of India. For the present, the posts are with the societies and not with the Zilla Parishad or the Government and no substantive posts are created. The scheme is only as per direction of Union of India. He thus submits that the petitions deserve to be dismissed as there is no vested right in any of the petitioners.
18. The learned AGP Ms. Gaur, while countering the argument in WP/527/2025, adopted the argument of learned Senior Advocate Mr. Sapkal. In addition, she submits that even if the benefits of salary are to be given, the petitioners would be entitled to get the benefits of arrears at the most for a period of three years preceding filing of the petition.

In support of the submissions of learned AGP, she relied upon the judgment passed by the Hon'ble Apex Court in Civil Appeal No.4134 of ( 83 ) WP-527-2025 + 2022 in the case of Rushibhai Jagdishchandra Pathak Vs. Bhavnagar Municipal Corporation dated 18.05.2022. The Hon'ble Apex Court in various other cases have held that the petitioners shall be entitled to get the arrears of salary only for three years prior to the date of filing of writ petition. This Court finds that the petitioner also entitled to get the benefits of arrears with bank interest. The Hon'ble Apex Court passed the judgment considering the judgment in the case of Union of India and Ors. Vs. Tarsem Singh. [(2008) 8 SCC 648].
20. To counter this, the learned Advocate Mr. Avinash Deshmukh, points out from WP/4465/2015 submitting that the posts are created in Zilla Parishad.
21. Learned Senior Advocate relied upon the following judgments:

22. He ultimately submits that the petitioners can at the most seek only equal salary but not regularization.
23. Learned Advocate Mr. Kaldate appearing for Zilla Parishad Osmanabad, submits that the petitioners were never employees of the Zilla Parishad. The Zilla Parishad is only looking to the work under the scheme being Nodal Agency. He also relied upon the letter dated 06/11/2025 (WP/6315/2015 Page 108). Mr. U. B. Bondar, learned Advocate for Zilla Parishad, Aurangabad and Latur, adopted arguments of learned Senior Advocate Mr. Sapkal.

Learned Advocate Mr. Rahul Bagul, appearing for Union of India, 10 AIR 1992 SC 789 11 AIR 2006 SC 1806 12 AIR 2009 SC (supp) 1054 13 AIR 1992 SC 2130 14 AIR 1987 SC 2049 ( 85 ) WP-527-2025 + supports the stand of the State Government and submits that the scheme is introduced and funded by the Union of India only for the purpose of implementation of the scheme.
25. The facts, in these writ petitions, are not disputed. The question is only about the entitlement of the petitioners to seek permanency benefits and regularization in the service. This Court has already noted that the scheme is introduced and funded by the Central Government. The work was initially carried out by the Zilla Parishad and is now carried out by the Society - MRRDA. From the record, it is seen that the petitioners were appointed by following due process of law and by creating posts. There is material on record in the form of advertisements to show that the appointments were made by following due process. The advertisement also provided for eligibility criteria, selection process etc. and even reservation policy is followed, just like other employment. The funds are received from the Government. Initially, it was the Zilla Parishad which was assigned the work of implementation of the scheme. The name of the scheme went on changing. However, the nature of the ( 86 ) WP-527-2025 + work remained the same. The petitioners continued to work on the same posts to which they were appointed since their appointments till date, except for technical breaks. There is material on the record wherein the directions were issued to give technical breaks with specific statement that, to avoid the liability of making the petitioners permanent, the breaks are to be given. This strengthens, the argument of the petitioners that the work is of permanent nature and that they are continuously working but for the technical breaks. It is also matter of record that the implementation of the scheme is extended till 2047. The construction of the roads, maintenance etc. is certainly the work of a permanent nature. Just by labeling it under a scheme, the Government cannot change the nature of work. This is coupled with the fact that, in the cases of Health Department, the Government has granted permanency benefits by regularizing the services of the person who were appointed by following due selection process, just like in the present cases.
26. So far as the argument of learned Senior Advocate that the scheme is looked after by the Society is concerned, this Court finds that all the ( 87 ) WP-527-2025 + office bearers of the society are necessarily officers of the Government at the Secretary level. By no stretch can it be said that the society is a private entity not fulfilling the criteria of "State" under Article 12 of the Constitution of India. This Court needs to consider the judgments relied upon by the learned Advocates for the respective parties.
27. In the case of Ajay Hasia and Ors. (supra). It is held that when a society is funded and controlled by the Government, it takes the character of the State for the purpose of Article 12 of the Constitution of India.
28. In the case of Dharam Singh and Ors. (supra), the appellants were engaged by the U.P. Higher Education Services Selection Committee (for short "Commission") between 1989 and 1992. The appellants served as Class-IV employees, and some of the appellants worked as Class- III employees and one as a driver. They were given daily wages and later on were paid consolidated monthly salary. The Commission therein had resolved to create fourteen posts of Class - III and Class - IV. The Government had even granted sanction for creation of posts. The ( 88 ) WP-527-2025 + appellants therein approached the High Court seeking permanency and regularization. The High Court, however, refused to grant the relief. The Hon'ble Apex Court by relying on the judgments in the case of Jaggo Vs. Union of India (supra) and Shripal and Anr. Vs. Nagar Nigam Ghaziabad15, observed that the outsourcing cannot become a convenient shield to perpetuate precariousness and to sidestep fair engagement practices where the work is inherently perennial. The Court further observed that where work recurs day after day and year after year, the establishment must reflect that reality in its sanctioned strength and engagement practices. It is observed that this is against Articles 14, 16 and 21 of the Constitution of India. The sensitivity to the human consequences of prolonged insecurity is not sentimentality. The constitutional discipline is required in every decision affecting those who keep public offices running. The Court also considered regularization and creation of supernumerary posts, financial consequent and arrears. It considered the cases of retired appellants, who retired during the pendency of the proceeding, the cases of deceased appellant etc. 15 2025 SCC OnLine SC 221 ( 89 ) WP-527-2025 + Ultimately, the Court observed that the work of the petitioners are perennial nature. It is also observed that it is not mere negligence but rather conscious method of denial that erodes livelihoods and dignity for these workers. The Court directed the creation of supernumerary posts and also directed regularization, subsequent financial benefits etc. and allowed the appeal.
29. In the case of Jaggo Vs. Union of India and Ors. (supra), the Hon'ble Apex Court held, in somewhat similar cases, that the service of the appellant therein was uninterrupted for periods extending well beyond ten years. It is held that such tenure cannot be brushed aside merely by labelling their initial appointments as part-time or contractual. The nature of such employment needs to be considered in the light of sustained contribution, the integral nature of the work and there was no evidence to suggest that the entries were through any illegal or surreptitious route. The Hon'ble Court in the judgment also considered the judgment in the case of Umadevi (supra) and distinguished the said judgment. It is observed that in the case of Umadevi (supra), the ( 90 ) WP-527-2025 + appointments were made dehors any procedure and were amounting to backdoor entries, whereas in the case at hand, the appointments were made by following procedure for appointment and selection process and there was nothing to indicate that the entries were backdoor entries.
30. In the case of Vinod and Ors. (supra), the Hon'ble Apex Court considered the entitlement of the employees to regularization by reclassification from temporary to regular employees on the ground of continuous service akin to permanent employees. In the said judgment also the case of Umadevi (supra) is considered. In the said case, the appellants were appointed to ex-cadre posts of Accounts Clerks after a selection process involving written tests, viva-voce and interviews. The appellants made representation for regularization in the year 1999. Since the same were not considered, they approached the Central Administrative Tribunal. The original applications were dismissed, holding that the appointments were of a temporary nature and for specific scheme, and refused to regularize the services or to absorb them into permanent posts. The High Court upheld the order of the Tribunal ( 91 ) WP-527-2025 + and thus the employees were before the Hon'ble Apex Court. The Hon'ble Apex Court considered the judgment of Umadevi (supra) and held that the reliance on procedural formalities cannot be used to perpetually deny substantive rights those have accrued over a considerable period through continuous service. Their promotion/appointments were based on a specific notification for vacancies and a subsequent circular, which was thereafter followed by a selection process involving written tests and interviews. This was taken to be distinguishing factor from the case of Umadevi (supra) wherein the appointments were held to be "irregular" and "illegal" whereas, in the present case the appointments were made on merits by following due process of law.
31. In the case of Sheo Narain Nagar and Ors. (supra), the Hon'ble Apex Court was dealing with a case where the appellants were initially engaged on daily wages basis in 1993. Later on in 1996, they were appointed on contractual basis. In the year 2000, the appointment orders were issued appointing the appellants as regular employees on ( 92 ) WP-527-2025 + the minimum pay scale. In the year 2006, they were confirmed with the status of temporary employees with retrospective effect from 2002. When the employees approached the High Court, the High Court only directed that their cases be considered for regularization and dismissed the writ petition. The order passed by the learned Single Judge was confirmed by the Division Bench. The employees thus were before the Hon'ble Apex Court. In the said case, the Hon'ble Apex Court held that the appellants had rendered the services for three years, when they were offered the service on contract basis. The case could not be said to be back door entry. There was no rule in place for offering such appointment and thus the appointment could not be said to be illegal or in contravention of Rules. In that view, the appeals were allowed directing that the services of the appellant therein be regularized from 02/10/2002 with consequential benefits and arrears of pay. The payment was directed to be paid within three months from the date of order.
32. This Court thus find that, in all above cases, the major ( 93 ) WP-527-2025 + considerations before the Hon'ble Apex Court were whether the appointments of the employees therein were backdoor appointments or were made by following due process. Secondly, as to whether the work was of perennial nature. Thirdly, whether the regularization can be granted. All these questions were answered in favour of the employees and relief were granted to the employees.
33. So far as judgments relied upon by the respondents are concerned, the first judgment is in the case of S. S. Rana Vs. Registrar, Co-op. Societies and Anr. (supra). In the said case, the writ petition was filed seeking direction to the Co-operative Societies. The Court considered that the Co-operative Society cannot be treated as "State" within the meaning of Article 12 of the Constitution of India. However, from the said judgment, it is seen that the co-operative society in that case, was neither creation of a statute nor was any violation of mandatory provisions was shown. There was no control over the society by the State and on that fact, it was held that the society is not "State" under Article 12 of the Constitution of India. This Court has already considered a ( 94 ) WP-527-2025 + judgment in the case of Ajay Hasia and Ors. (supra). This Court find in the present case that the judgment in the case of Ajay Hasia and Ors. (supra) is clearly applicable.
34. In the case of M. D., U. P. Land Development Corporation and Anr. (supra), the persons were appointed for training under the scheme on fixed stipend. There were no regularly sanctioned posts available. The scheme under which the employees were appointed was also closed. The High Court, however, had allowed the writ petition and thus the Corporation had been to the Supreme Court. In the said case, the services were continued under the order of the Court. The Hon'ble Apex Court observed that no vested right is created in temporary employment and no directions could have been issued in absence of any existing vacancies. No direction to create posts could have been issued in non- existent establishment. In that view, the appeal was allowed.
35. In the present case, the appointments were made by following regular selection process. The establishment is very well available. From the documents, it is shown that the scheme will continue till 2047. In ( 95 ) WP-527-2025 + any case, the construction and maintenance of roads cannot be said to be work of temporary nature. It is necessarily work of a regular nature.
36. In the case of Madhyamik Siksha Parishad, U.P. (supra), it was held that there were no sanctioned posts in existence to which the respondents therein could be appointed. The assignment was ad-hoc one for particular period. In the case of Delhi Development Horticulture Employees' Union (supra), it was the case under Jawaharlal Nehru Rozgar Yojna. It was held that the appointment could not have been continued after expiration of the scheme. The employment was through implementing machinery of the Jawaharlal Nehru Rozgar Yojna. The work was given purely on daily wages basis. There was nothing to indicate that the nature of the work was of perennial nature or that sanctioned posts were available.
37. In the case of Secretary, State of Karnataka and Ors. Vs. Umaevi an Ors. (supra). In the said case, the appointments were made as backdoor entries. The appointments were on daily wages basis or temporary/contract basis. The appointments were also in violation of ( 96 ) WP-527-2025 + constitutional scheme. In the said case, direction was given to regularize the employment by treating them as permanent. This judgment has already considered in the case of Jaggo Vs. Union of India and Ors. (supra). This Court, therefore, finds that the judgments relied upon by the petitioners are perfectly applicable in the present case.
38. In the case of Md. Abdul Kadir and Anr. (supra), in the said case also the appointments were made for a particular project. It was held that merely because the scheme was in operation for some decades or that the employees continued on ad-hoc basis for one or two decades, would not entitle them to seek permanency or regularization. This judgment is already considered in the case of Jaggo (supra).
39. In the present case, these persons were not appointed on a daily wages basis but were appointed under the scheme. The said scheme is continued till now. As per the material on record, it is to be continued even till 2047. The fact remains that they were appointed like any other employees on permanent basis. The posts are also created initially.

40. In the case of State of Haryana and Ors. Vs. Piara Singh and Ors . (supra), it was held that an ad-hoc employee cannot be replaced by another ad-hoc employee. It was accepted fact that the persons were working as ad-hoc employees. In the case of Bhagwan Dass and Ors. (supra), it was held that the employees were appointed under the scheme. They were appointed for six months each time by giving technical break. The appointment was under temporary scheme and in that view, it was held that the employees would not be entitled to be absorbed as regular employees on permanent basis from the date of initial appointment. It was held that however, they would be entitled to get pay on the basis of length of service computed from the date of their appointment, disregarding the breaks given to them for limited purpose. This judgment also, in fact, held that the persons are required to be paid as per scheme only what was denied was regularization.
41. At this stage, it is the material to see that the present Society is also a "State" under Article 12 of the Constitution of India. The learned Advocate Mr. Deshmukh relied upon the judgment in the case of Ajay Hasia and Ors. (supra). It is held that when society is controlled by the ( 98 ) WP-527-2025 + State, it can be treated as an instrumentality of the State under Article 12 of the Constitution of India. In the present case, it is clearly seen that initially, the appointments were made by the Zilla Parishad, as at the relevant time, the implementing machinery was the Zilla Parishad. Though now a society has been established, it is clearly seen that the scheme is funded by the Union of India. The society is established, funded and controlled by the State. The only purpose for which the society is established is to implement the scheme, which is extended till 2047. This Court has already held that the work is of perennial nature. The Government Resolution dated 31/07/2018 also clearly shows that the technical breaks are given only with the view to see that no right of permanency is created. Government Resolution itself shows that the work is of perennial nature and the Government has every apprehension that if no technical breaks are given benefits of permanency will have to be given as the work is of perennial nature. The welfare Government is not expected to adopt such tactics and deny the benefits of permanency to the employees. Though the petitions are to be allowed, this Court finds the submissions of learned AGP to be correct so far as the payment ( 99 ) WP-527-2025 + of the arrears is concerned. The petitioners are entitled to get the arrears of salary for the period of three years preceding date of filing of the petition with bank interest.
42. For all these reasons, this Court finds that writ petitions deserve to be allowed with following directions.
43. Hence, following order:-
ORDER
(i) Writ Petitions stand allowed.
(ii) The Respondents-Authorities are directed to regularize the services of all the petitioners on their posts with effect from their respective initial dates of joining in service, with consequential benefits. Arrears of pay to be paid to the petitioners in all these writ petitions within a period of 6 months from today as per Rule.
(iii) Respondents-Authorities to create the posts to absorb the petitioners as either in Zilla Parishad or in the State Government or in the Society.

(iv) Petitioners shall be entitled to receive the arrears of salary for a period of three years preceding date of filing of the petition with bank interest.
(v) Rule made absolute in above terms.
(vi) In view of disposal of these writ petitions, pending Civil Applications, if any, do not survive and same also disposed off accordingly.
