Section 38 in The Punjab Relief of Indebtedness Act, 1934
38. [ Penalty for use of documents containing false entries. [Added by Punjab Act 12 of 1940, section 18.]
(1)If any party to a suit for the recovery of a loan dishonestly uses in such suit any document in which he is aware that there is any statement or entry relating to such loan which is false in any material particulars he shall on conviction be punished with imprisonment of either description which may extend to three months or with a fine not exceeding one thousand rupees or with both.(2)If the court is satisfied, after such preliminary enquiry, if any, as it thinks necessary that there is ground for enquiring into an offence under sub-section (1) the court may record a finding to that effect and prefer a complaint of the offence in writing to a magistrate to the first class having jurisdiction, and such Magistrate shall deal with such complaint in the manner laid down in the Code of Criminal Procedure, 1898].
