Instant writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondent No. 1 to decide the appeal tiled as Virender Kumar Aggerwal Vs. Shri Sanatan Sharam Sabha, Ambala City in a time bound manner.
Learned counsel for the petitioner submits that the petitioner has filed an appeal before the Registrar General of Firms & Societies, Haryana at Chandigarh. As on 01.03.2016, the Registrar General of Firms and Societies was on leave, the cases were not being taken up by the officer, who has been given additional charge of the said post. However, in spite of having additional charge, the appeal is not being taken up even for preliminary consideration by the concerned authority and no date has been given so far.
I have heard learned counsel for the petitioner and perused the paper-book.
1 of 2 ::: Downloaded on - 05-06-2016 00:03:51 ::: 2 CWP No. 11277 of 2016 The officer, who has been given additional charge of the Registrar General of Firms and Societies, Haryana should take up the appeal and the application for stay in the appeal, if any of the petitioner, on or before 06.06.2016 and pass appropriate order, in accordance with law, in the appeal as well as in the stay application. Since the execution is stated to be pending for 18.06.2016, the officer with additional charge must take the appeal for preliminary hearing and the application on the date fixed i.e. 06.06.2016.
Disposed of in above terms.
