     THIS PETITION COMING ON FOR PRELIMINARY HEARING

IN 'B' GROUP THIS DAY, THE COURT MADE THE FOLLOWING:


                              ORDER

The petitioner has challenged the Orders dated 26.06.2015 and 04.09.2015 - Annexures 'G' and 'J1' respectively passed by the Court of XXXVII Additional City Civil Judge, Bengaluru, (for short, 'Trial Court') in O.S. 6 No.6922/1996. By Order dated 26.06.2015, an application filed by the learned counsel for plaintiff Nos.4 to 9 (stated as plaintiff Nos.1 to 4 in the said Order) under Sections 18 and 19 of the Karnataka Court Fees and Suits Valuation Act, 1958 (for short 'the Act of 1958'), seeking to issue notice to the State Government or such other authority for the purpose of determination of market value of the suit schedule property in order to determine the additional court fees, if any, payable by the plaintiff Nos.1 to 4 was rejected. By Order dated 04.09.2015, the Trial Court rejected an application filed by the plaintiffs under Section 151 of the Code of Civil Procedure, 1908 (for short, 'the CPC') to take on record an endorsement issued by the Sub-Registrar / Public Information Officer with cost.

2. The suit in O.S. No.6922/1996 was filed for relief of declaration that the property described in the suit schedule formed part of the estate of late Sri K.M.Janardhana Reddy and consequently, the plaintiffs had inherited the said property and for perpetual injunction 7 restraining the defendants from interfering with the possession of the plaintiffs over the suit schedule property.

3. The suit property was a tomb of late Sri K.M.Janardhana Reddy, who died in July 1978 and his ancestors/family members who were laid to rest. The plaintiffs claimed that they were related to the said Sri K.M. Janardhana Reddy and claimed that this property was in their possession and enjoyment. They alleged that the defendant No.1 is the wife of Sri K.N.Mohan Reddy, son of late Sri K.M. Narayana Reddy, who was one of the brothers of late Sri K.M. Janardhana Reddy. In view of certain dispute over title to the tomb of Sri K.M. Janardhana Reddy and his family members, the present suit was filed.

4. The suit was contested by the defendants, whereupon issues were framed by the Trial Court. The Trial Court framed issue Nos.5 and 6 as preliminary issue and in terms of the Order dated 17.02.2014, answered preliminary issue No.5 in the affirmative and preliminary issue No.6 in the negative and directed the plaintiffs to 8 value the suit based on the market value of the suit schedule property by producing the valuation certificate of the Government and to pay the deficit court fee. At this stage, an application was filed by the learned counsel for plaintiff Nos.4 to 9 under Sections 18 and 19 of the Act of 1958 to issue notice to the State Government for determination of the market value of the suit schedule property in order to determine the additional court fees, if any, payable by the plaintiffs. The said application was opposed by the defendants and the Trial Court after considering the contentions urged, rejected the same in terms of the Order dated 26.06.2015. Thereafter another application was filed by the plaintiffs under Section 151 of the CPC., seeking to accept an endorsement issued by the Sub-Registrar / Public Information Officer to the effect that there was no guideline value prescribed for the suit schedule property, which is a tomb site. That application was also rejected by the Trial Court.

5. Being aggrieved by the said Orders dated 26.06.2015 and 04.09.2015, the present petition is filed. 9

The learned counsel for the petitioner/plaintiff No.6 after arguing the petition at length, submitted that the petitioner wanted to value the market value of the suit property in the year 1996 at a sum of Rs.1,00,00,000/- and undertakes to pay the court fee on such market value. He has filed a memo to that effect.

7. In view of the aforesaid memo, the impugned Orders dated 26.06.2015 and 04.09.2015 passed by the Trial Court in O.S. No.6922/1996 are set aside. Consequently, the Trial Court is directed to accept the valuation of the suit property at a sum of Rs.1,00,00,000/- as proposed by the petitioner and permit the petitioner to pay the ad valorem court fee under Section 24(b) of the Act of 1958. It will be open however for the Trial Court to recover applicable Court fee if it is found that the Court fee paid by the plaintiffs is insufficient or if the market value of Rs.1,00,00,000/- claimed by the petitioner herein / plaintiff No.6 is incorrect.

8. Since the aforesaid suit is filed in the year 1996, the Trial Court is directed to accept the same and take up the same on day-to-day basis and dispose off the same within a period of one year from the date of receipt of a certified copy of this Order.
